In instances where parkland <br />dedication is 'requi~:ed to be satisfied with a cash payment, any existing <br />developed lot without thc boundaries of the plat is exempt from any cash <br />payment due on the plat. In the case of a request to divide a lot which is a <br />part of a recorded plat where the division is to permit the adding of a parcel <br />of land to an abutting lot which does not create a new buildable lot, thc <br />subdivider shall be exempt from complying with any procedural <br />requirements o£this Section. <br /> <br />Application to Re-subdivision. <br /> <br />In the event of a re-subdivision of a parcel for which park dedication <br />requirements have previously been met, no additional park dedication <br />requirements shall be imposed as a result of the re-subdivision <br />providing, the overall density of development of the parcel remains the <br />same as the density allowed under the zoning in effect at the time of <br />the initial subdivision. <br /> <br />In the event that park dedication requirements were met through the <br />use of a fee per dwelling unit additional park dedic-~: ........ ~ .......... <br />for each new buildable lot created under re-subdivL, 9.50.30 <br /> <br />I <br />I <br />I <br />I <br /> <br />The park dedication fee shall be based on the specified contribution <br />per dwelling unit for residential properties resulting from the re- <br />subdivision. <br /> <br />mo <br /> <br />Application to No Subdivision. A developer of a commercial, industrial or <br />residential development for which no subdivision of property is required <br />shall comply with the park dedication and trail development fee <br />requirements of this Chapter as if a subdivision were required prior .to <br />receiving any building permit. <br /> <br />Subd. 8. No land shall be subdivided which is unsuitable for the <br />reason of flooding, inadequate drainage, water supply or sewage treatment <br />facilities. All lots within the flood plain districts shall contain a building site <br />at or above the Regulatory Flood Protection Elevation. All subdivisions <br />shall have water and sewage treatment facilities that comply with the <br />provisions of this Section and have road access both to the subdivision and <br />to the individual building sites no lower than two feet below the Regulatory <br />Flood Protection Elevation.
