Prior to commencement of ~ading activities, the Developer must fulfill all of the <br />abovementioned obligations. <br /> <br />Staff has reviewed the Grading Plan and finds it acceptable subject to the comments contained in <br />the Staff Review Letter dated September 4, 2003. <br /> <br />The Developer has indicated a desire to scale back the nmnber of units for his final plat <br />application. With the absence of that submittal, Staff felt that it was appropriate to leave the <br />number of units in the development ageement so that it coincided with the most recent <br />submittal. Upon submittal of the final plat application, the Development Agreemen~ will need to <br />be modified to reflect the changes and resubmitted for City, Council approval. <br /> <br />Recommendation: <br /> <br />Staff reco~runends approval of the Final Grading Plan for Town Center Gardens contingent on <br />satisfying the comments contained in the City Staff Review Letter dated September 5, 2003. The <br />Developer may com_mence ~ading activities once the following obligations are satisfied: 1) <br />Approval of the Final Grading Plan; 2) The Develope~ entering into a Development Ageement <br />with the City of Ramsey; 3) The Developer posting a Letter of Credit in the amount of 125% of <br />the cost of the ~ading work; 4) The Developer depositing c ash for City inspections, 5 ) T he <br />Developer providing the City a copy of the Lower Rum River Watershed Management <br />Organization perm/t; and 6) The Developer and City holding a pre-construction meeting. <br /> <br />City Council Action: <br /> <br />Motion to approve the Final Grading Plan for Town Center Gardens contingent on satisfbdng the <br />comments contained in the Cib, Staff Review Letter dated September 5, <br /> <br />Motion to allow the Developer to co~mnence ~ading activities once the following obligations are <br />satisfied: 1) Approval of the Final Grading Plan; 2) The Developer entering into a Development <br />A~eement with the Cie' of Ramsey; 3) The Developer posting a Letter of Credit in the amount <br />of ~25% of the cost of the ~ading work; 4) The Developer depositing cash for City inspections, <br />5) The Developer providing the City a copy of the Lower Rum River Watershed Management <br />Organization permit; and 6) The Devel'oper and City holding a pre-construction meeting. <br /> <br />-or- <br /> <br />Motion to recommend denial of Final Grading Plan of Town Center Gardens. <br /> <br />Review Checklist: <br />Community Development Director <br />Assistant CommuniW Development Director <br /> <br />-178- <br /> <br /> <br />
