Voting No: None. <br /> <br />Case #6: <br /> <br />Request for a Conditional Use Permit to Exceed Size Restrictions for <br />Accessory Structures; Case of Michael St. Hilaire <br /> <br />Cormnunity Development Director Frolik stated that City Code restricts accessory structure <br />building size based on the size of the parcel. The City has received an application from Michael <br />St. H/la/re for a conditional use permit to exceed the detached accessory building size restrictions <br />established in City Code on the property located at 6251 169th Lane NW, The subject property is <br />approximately 1.75 acres in size; City Code restricts accessory buildings to 1,664 square feet on <br />parcels this size. The applicant is proposing to construct a detached garage that would be 1,200 <br />square feet. Based on the existing accessow square footage, the new building would exceed the <br />allowable total for the parcel by 352 square feet. The applicant is requesting the additional square <br />footage to construct a building to store personal property. The applicant is limited to three <br />accessory structures on the property. The proposed detached accessory building will comply <br />with all of the setback requirements and accessory structure height restrictions established in City <br />Code. The applicant is proposing aluminum or hardboard siding for the structure to match the <br />color of the house (which has hardboard siding with brick detailing). Code violations relating to <br />unlicensed and/or inoperable vehicles and other outdoor storage have occurred on the property in <br />the past; in light of this fact, staff recommends granting the request for additional storage. The <br />Pla~ming Corrm~ission and staff recormnended granting the request for conditional use permit. <br /> <br />Councilmember Elvig stated that he has been by the site and the reason the Council would grant <br />a conditional use permit for this property is to get the stuff cm'rently stored outside covered. He <br />inquired if it was going to be possible to gel all the stuff currently stored outside in the new <br />building. <br /> <br />Michael St. Hilaire, 6251 169t~' Lane NW~z, Ramsey, replied that some of the stuff will be going <br />fl~side the building, but not all of it. The pm-pose of the structure is too clean up the yard, but it <br />will be impossible to get eve .ryt, hing in the structure. <br /> <br />Councilmember Elvig inquired as to how the City could require that the property get cleaned up <br />enough so that it is not a concern for the neighbors. <br /> <br />Mr. St. Hilaire replied that the structure will help clean up the front yard. <br /> <br />Councihnember Elvig inquired if maintenance of property is being looked at as part of the <br />Chapter 9 re-write. <br /> <br />Community Development Director Frolik reviewed the cra-rent City code. <br /> <br />Councilmember Elvig requested that the Council review the ordinance because if in fact the <br />property is in compliance with the current ordinance then they need to clean up the ordinance. <br /> <br />-88- <br /> <br />City Council/August 26, 2003 <br /> Page 10 of 25 <br /> <br /> <br />
