The subdivision is a replat of Lot 1, Block 1, Riverview Estates into 2 <br />commercial lots. One to facilitate the existing Comfort Suites Hotel and the Applicants are <br />marketing the resulting vacant lot for development with a restaurant. The following items are <br />enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Final plat <br />Site plan <br />Development Agreement <br />Letter from Michael McCollum, attorney representing Dana and Duke Grosslein, <br />dated January 6, 2000 <br /> <br />Notification: <br /> <br />No public notification is required for amendments to development agreements. <br /> <br />Observations: <br /> <br />As of this date, the plat has not been recorded at the County and the subject property remains as <br />one commercial lot. As you can see from the site plan, access is provided to the property from <br />Hwy. # 10, Sunfish Lake Blvd. and Riverdale Drive N.W. When the subdivision of the lot into <br />two lots is recorded, the hotel site will have the access from Hwy. #10 and the access from <br />Riverdale. The restaurant site will have the access from Sunfish Lake Blvd. and the access from <br />Riverdale. (The Riverdale access is platted on the common property line between the two lots). <br /> <br />At the time of final plat approval, it was anticipated flaat both lots would want to share all public <br />accesses, not just the one on Riverdale. Cross easements giving the hotel site legal use of the <br />Sunfish Lake Blvd. access and the restaurant site legal use of the Hwy. #10 access would be <br />required to facilitate this. Consequently, the development agreement was drafted to require the <br />Developer to provide the City with such easements in recordable form. <br /> <br />All obligations of the development agreement have been met with the exception of providing the <br />City with evidence that access easements between Lots 1 and 2 have been drafted in recordable <br />form. When these easements are provided, City Staff can release the plat for recording at the <br />County. <br /> <br /> <br />
