The p~'operty is approxima*ely 35 acres in <br />size. It is located in the Rural Service Area for which there ;.; a density restriction of 4. units in <br />40 acres. The additional home on the property would ',or violate the der~.siW restrictions <br />established in the current Comprehensive Plan or the 12/21/95' draft Comprehensive Plan, if it is <br />approved by Metro Council. If or when there is a desire to p!~t the dwellings onto separate lots <br />of record, there is a sufficient distance between the two homes to do so ava meet setback <br />requirements. <br /> <br />The proposed home exceeds minimum size standards established in City Code. <br /> <br />Conditional use permits have been issued in the past for more than one dwelling on a residential <br />lot. The Delaney family estate (Armstrong Kennels) has a conditional use permit for 4 <br />dwellings. The Thomaswood Estate (Tom Kurak homestead) was granted a conditional use <br />permit for two dwellings in order that the seller, Mr. Thom, could live out the rest of his life on <br />the property. <br /> <br />The Planning Commission conducted a public hearing on January 4, 2000. The neighboring <br />property owner to the west spoke in opposition to the request. One area of concern was that the <br />hobby farm is located at the terminus of a dead-end street, which is appropriately signed but the <br />radius of the tm-around is very tight.
