Councilmember Reimann introduced the motion to adopt the following findings of <br />fact: <br /> <br /> FINDINGS OF FACT <br /> FOR THOMAS KURAK <br /> 0075 <br />1) That the Applicant has properly applied for a Board of Adjustment variance as <br />required by City ordinance to place a second structure on a single parcel of land without <br />frontage on a public street. <br /> <br />2) That on January 3, 1984, Mr. Kurak appeared before the City of Ramsey Planning <br />and Zoning Commission under Citizen's Input and requested their input on his request. <br /> <br />3) That the Applicant appeared before the Board of Adjustment for a public hearing <br />on Tuesday, January 24, 1984. That said public hearing was properly advertised and <br />that the minutes of said public hearing are incorporated as a part of these findings <br />by reference. <br /> <br /> I <br />I <br /> I <br /> <br />4) That the City of Ramsey Planning and Zoning Commission has recommended approval <br />of the Applicant's request with conditions and l'.'at said conditions are included as <br />a part of their minutes which are hereby incorporated as a part of these findings by <br />reference. <br /> <br />5) That the subject property is approximately 00 acres in size and is located on the <br />Easterly side of Sunfish Lake Blvd. NW. <br /> <br />6) That the densities generated by the construction of another dwelling will not exceed <br />the standards set forth by the Comprehensive Plan. <br /> <br />7) That there are exceptional circumstances that do apply to this property that do <br />not apply to properties in general inasmuch as it is' served only by an easement. <br /> <br />8) That said variance is necessary for the preservation of a substantial property right <br />similar to other properties in the same zoning district and vicinity. <br /> <br />9) That said variance will not be a detriment to adjacent properties and will not <br />materially impair the intent and purpose of this ordinance or the public interest. <br /> <br />10) That the condition of the specific piece of property is not as general or recurrent <br />in nature as to make reasonably practicable the formulation of a general regulation <br />for such conditions. <br /> <br />11) That the variance observes the spirit and intent of this ordinance, produces <br />substan.tial justice and is not contrary to the public interest. <br /> <br />The motion for the adoption of the foregoing findings of fact was duly seconded by <br />Mayor Gamec and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Gamec, Councilmembers Reimann, Schlueter, Van Wagner and Sorteberg <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />whereupon said findings of fact were declared duly passed and adopted by the Ramsey <br />City Council this the Z4th day of January, 1984. <br /> <br />ATTEST: <br /> <br /> <br />
