Councilmember Reimann introduced the motion to adopt the following findings of fact: FINDINGS OF FACT FOR THOMAS KURAK 0075 1) That the Applicant has properly applied for a Board of Adjustment variance as required by City ordinance to place a second structure on a single parcel of land without frontage on a public street. 2) That on January 3, 1984, Mr. Kurak appeared before the City of Ramsey Planning and Zoning Commission under Citizen's Input and requested their input on his request. 3) That the Applicant appeared before the Board of Adjustment for a public hearing on Tuesday, January 24, 1984. That said public hearing was properly advertised and that the minutes of said public hearing are incorporated as a part of these findings by reference. I I I 4) That the City of Ramsey Planning and Zoning Commission has recommended approval of the Applicant's request with conditions and l'.'at said conditions are included as a part of their minutes which are hereby incorporated as a part of these findings by reference. 5) That the subject property is approximately 00 acres in size and is located on the Easterly side of Sunfish Lake Blvd. NW. 6) That the densities generated by the construction of another dwelling will not exceed the standards set forth by the Comprehensive Plan. 7) That there are exceptional circumstances that do apply to this property that do not apply to properties in general inasmuch as it is' served only by an easement. 8) That said variance is necessary for the preservation of a substantial property right similar to other properties in the same zoning district and vicinity. 9) That said variance will not be a detriment to adjacent properties and will not materially impair the intent and purpose of this ordinance or the public interest. 10) That the condition of the specific piece of property is not as general or recurrent in nature as to make reasonably practicable the formulation of a general regulation for such conditions. 11) That the variance observes the spirit and intent of this ordinance, produces substan.tial justice and is not contrary to the public interest. The motion for the adoption of the foregoing findings of fact was duly seconded by Mayor Gamec and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec, Councilmembers Reimann, Schlueter, Van Wagner and Sorteberg and the following voted against the same: None whereupon said findings of fact were declared duly passed and adopted by the Ramsey City Council this the Z4th day of January, 1984.
