Except road subject to <br />easements of record. <br /> <br />and <br /> <br /> WHEREAS, the City's Board of Adjustment adopted Findings of <br />Fact on the 24th day of January, 1984, which Findings are <br />incozf, orated herein as if fully set forth; and <br /> <br /> WHEREAS, the Board of Adjustment by motion approved the above <br />described variances conditioned on certaiin agreements with the <br />Applicant: ..... <br /> <br /> NOW, THEREFORE, it is agreed by and between the parties <br />hereto as follows: <br /> <br /> 1) That the Applicant is given a variance to enable him to <br />construct.a single family dwelling on that certain 60 acre tract <br />of land legally described above. <br /> <br /> 2) That the Applicant agrees that he is solely responsible <br />for the maintenance and upkeep of the private ingress and egress <br />easement serving the said approximate 60 acre tract of land from <br />County Highway #57 and that the City accepts no responsibility or <br />liability whatsoever for maintenance and/or upkeep of said <br />easement. <br /> <br /> 3) That the Applicant shall not be issued a building permit <br />for the said approximate 60 acre tract of land unless and until <br />he presents a deed evidencing his ownership of fee title to the <br />approximate 60 acre tract aforedescribedl <br /> <br /> 4) That the Applicant understands and agrees that the said <br />approximate 60 acre tract may not be subdivided without <br />compliance with the City Code. <br /> <br /> 5) That the residence and any accessory structures to be <br />constructed by the Applicant on the said approximate 60 acre <br />tract shall be located in such a manner so as to comply with all <br />City Code setback requirements. <br /> <br /> 6) That this Agreement shall run with the land and be <br />binding on the Applicant's heirs, successors and/Or assigns. <br /> <br /> <br />
