CASE <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />FOR TWO DWELLINGS ON ONE PARCEL; CASE OF DONALD KVETON <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that there shall not be more than one main building on a lot unless otherwise <br />provided for in City Code. Mr. Kveton is in the process of building his home at 5750 177* <br />Avenue N.W. (Lot 3, Echo Ridge) and he is requesting a conditional use permit to maintain a <br />second dwelling on the property to provide separate living quarters from his own for the <br />caretakers of his hobby farm. The property is approximately 35 acres in <br />size: It is located in the Rural Service Area for which there is a density restriction of 4 units in <br />40 acres. The additional home on the property would not violate the density restrictions <br />established in the current Comprehensive Plan or the 12/21/99 draft Comprehensive Plan. When <br />there is a need or desire to plat the dwellings onto separate lots of record, there is a sufficient <br />distance between the two homes to do so and meet setback requirements. <br /> <br />The proposed home exceeds minimum size standards established in City Code. <br /> <br />Conditional use permits have been issued in the past for more than one dwelling on a residential <br />lot. The Delaney family estate (Armstrong Kennels) has a conditional use permit for 4 <br />dwellings. The Thomaswood Estate (Tom Kurak homestead) was granted a variance for two <br />dwellings in order that the seller, Mr. Thom, could live out the rest of his life on the property. <br />The Kurak and Thom homes were subsequently subdivided onto separate lots of record by a <br />metes and bounds subdivision. A copy of the Delaney conditional use permit and the Kurak <br />variance, and meeting minutes relating to their cases, is attached. <br /> <br />101 <br /> <br /> <br />
