The Planning Commission conducted a public hearing on January 4, 2000. The neighboring <br />property owner to the west spoke in opposition to the request. One area of concern was that the <br />hobby farm is located at the terminus of a dead-end street with a cul-de-sac that appears to be <br />inadequately sized. The consensus of the Planning Commission was that 177th is appropriately <br />marked as a 'dead end' street. The Commission forwarded the case to the City Council with a <br />recommendation for approval. <br /> <br />On January 25, 2000, the City Council reviewed the case. During the discussion, it was <br />determined that the caretaker house is nearly ail constructed. Sometime in October, the applicant <br />was informed of the need for a conditional use permit to have two dwellings on one lot. The <br />applicant was instructed to submit an application for a conditional use permit by November 16 in <br />order to be placed on the December agendas of the Planning Commission and City Council. <br />Because of the time of year and impending cold weather, City Staff entered into a hold harmless <br />agreement with the applicant to allow the installation of frost footings, at the risk of the <br />applicant, prior to the issuance of a conditional use permit and building permit. The one staff <br />member left in the Community Development Department at that time took an unexpected <br />medical leave at the end of October. Consequently, there was no other community development <br />staff around to follow up with Mr. Kveton to make sure the application got filed and the hearing <br />got scheduled. Upon Staff's return from m6dieal leave, it was noted that the conditional use <br />permit still had not been processed. Staff made the necessary contacts and the matter was <br />scheduled for a hearing at the Planning Commission meeting in January. <br /> <br />The Council tabled action on the case and requested additional information. <br /> <br />Recommendation: <br /> <br />Will be based on Council's discussion. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #00-01~/ adopting Findings of Fact #. relating to Mr. <br />Kveton's request for a conditional use permit for two dwellings on one parcel. <br /> <br />Motion to approve Mr. Kveton's r~Caest for a conditional use permit based on the findings of <br /> a O J. . <br />t] ct and adopt Resolution #00-01-L'~ declaring terms of same <br /> <br />-or- <br /> <br />Motion to deny Mr. Kveton's request for a conditional use permit based on the find.ings of fact. <br /> <br />Review Checklist: <br />City Administrator <br />City Attorney <br /> <br />CC: 02/08/00 <br /> <br /> <br />
