I

I
I
I
I

Case//3:

Request to Vacate Drainage and Utility Easement; Case of Paul and Lois
Bach

Community Development Director Frolik explained that on January 11, 2000, the City Council
introduced an ordinance to vacate the drainage and utility easement on the former common
property line of the Bach parcel at 16801 Radium Street N.W. and the Karst parcel at 16747
Radium Street N.W. The Bachs are replacing the drainage and utility easement along the new
common property line between the two lots. She provided a copy of the revised ordinance which
corrected the legal description and advised that the Bachs will provide the City with a corrected
quit claim deed. City Staff recommends adoption of the ordinance to vacate the drainage and
utility easement on the former common property line.

Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to adopt
Ordinance #00-XXX to vacate a portion of the drainage and utility easement on Lots 6 and 7,
Block 4, Klemish Addition.

A roll call vote was performed by the recording secretary:

Councilmember Anderson aye
Councilmember Connolly aye
Councilmember Hendriksen aye
Mayor Pro tem Zimmerman aye
Mayor Gamec absent

Motion carried.

Case #4:

Request for a Conditional Use Permit for .Two Dwellings on One Parcel;
Case of Donald Kveton

Community Development Director Frolik explained that City Code states that there shall not be
more than one main building on a lot unless otherwise provided for in City Code. Mr. Kveton
has a dwelling at 5750 177~ Avenue N.W. (Lot 3, Echo Ridge) and is requesting a conditional
use permit to maintain a second dwelling (carriage house) on the property to provide separate
living quarters from his own for the caretakers of his hobby farm. She noted the documentation
contained within the Council's meeting packet. The Planning Commission conducted a public
hearing on January 4, 2000. The neighboring property owner to the west spoke in opposition to
the request. One area of concern was that the hobby farm is located at the terminus of a dead-end
street, which is appropriately signed but the radius of the turn-around is very tight. Community
Development Director Frolik explained that subsequent to the Planning Commission, staff
reviewed the Echo Ridge development agreement which indicates the developer was to plat each
lot with 200 feet of frontage; there is a deficiency of 100 feet on the Kveton lot. She stated that,
in her opinion, extending the road another 100 feet will not solve the problem and recommended
the cul-de-sac be enlarged to accommodate easier vehicle turnaround.

City Council/January 25, 2000
