I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />05/10/0~ 11:20 LRW OFFICES 2140 4TH RUE ~ 612 42? 5545 <br /> <br />N0.416 P05 <br /> <br />Mn/DOT Agmernen~ No.' 79780-P <br /> <br />WHEREAS, pursuant to Minnesota Statutes Section 471.59, subdivision 1, two governmental units may enter <br />into an agreement to cooperatively exercise any power common to the contracting parties, and one of the <br />participating governmental units may exercise one of its powem on behalf of the other governmental unit. <br /> <br />IT IS, TItEREFORE, iYIUTUALLY AGREE~ AS FOLLOWS: <br /> <br />ARTICLE,I,- TERMS OF AGREEMENT <br /> <br />This agreement shall be ¢ffecd,e¢ upon execution and approval by thc appropriate City and State officials <br />pursuant to 1~ mnesota law and shall remain in effect until the completion of City let Construction Project SP <br />199-010-03, SP 0206-50 that is scheduled to begin in the Spring of 2000 and be finished on December 31, 2001. <br /> <br />ARTICLE II - PERFORMANCE OF CONSTRUCTION ENGINEERING <br /> <br />C$ <br /> <br />Upon requert of the City, the State shall assume control and performance of construction engineering and <br />inspcotion in the manner cun-ently used by the State for thc roadway portions of thc contract which are the <br />responsibility of the City of Ramsey. <br />Upon request of thc City, the State shall assume control and pefformanc~ of construction engineering in thc <br />manner currently used by the State for the portions of thc contract which involve City sewer and water <br />main_.~ <br /> <br />At any time prior to both parties agreeing on a time schedule, each party to thls Agreement reserves the <br />fight to withdraw from and cancel this Agreement. Withdrawal from or cm~cellation o£th, Agreement <br />must bc accomplished by either party serving a 30 day written notice' upon the other's authorized agent. <br />The State will provide all labor, equipment, and materials necessary to perform the construction <br />engineering and inspection covcrext under this Agreement, <br />All inspection, control of materials, and associated documentation for the Construction to be performed in <br />accordance with thc Construction plans, specifications, and/or special provisions will be the responsibility <br />of the State's engineer assigned to the Construction. <br />At regular intervals after the City's contractor has started the Construction, thc State will prepare partial <br />estimates of construction co~s in accordance with thc terms of thc construction contract. Immediately <br />after thc preparation of each partial estimate, the State's engineer assigned to the Con~amcfion will submit <br />the partial estimate to the City. The State will also prepare th, f'mal construction cost data for the <br />Construction and submit the f'mal construction cost data to the City. <br /> <br />Page 2 of 6 <br /> <br /> <br />
