I <br /> I <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> WHEREAS, the real property described below (the "Subject Property") can feasibly be <br />connected to municipal utilities and has good development characteristics for development as an <br />industrial park; and <br /> <br /> WHEREAS, pursuant to Minn. Stat. {}469.124, et. seq. (the "Development District Act") <br />the City has established Development District No. 1 (the "Development District") by resolution <br />duly adopted, and subsequent resolutions, the City adopted the Development Program and <br />approved creation of the Development District; and <br /> <br /> WHEREAS, the purpose of the State Legislature in establishing City Development <br />Districts, is to promote new development in areas of a city that are already built up in order to <br />provide employment opportunities, to improve the tax base, and to improve the general economy <br />of the State; and <br /> <br /> WHEREAS, Minn. Stat. {}469.124, in order to accomplish said statute's purpose, <br />authorizes cities, amongst other things, to develop a program for improving a Development <br />District of the City to provide impetus for commercial development, to increase employment, to <br />provide off-street parking to serve the shoppers and employees of the district to provide open <br />space relief within the District, to protect pedestrians from vehicle traffic and inclement weather; <br />and <br /> <br /> WHEREAS, Minn. Stat. §469.124 further declares that the actions to assist the <br />implementation of the above development programs authorized by said statute are a public <br />purpose and that the execution and financing of these programs are a public purpose; and <br /> <br /> WHEREAS, the City, pursuant to Minn. Stat. §469.126, Subd. (2), has the authority to <br />acquire land by eminent domain within its Development Districts; and <br /> <br /> WHEREAS, the City has authority to acquire real property for public purposes by <br />eminent domain pursuant to Minn. Stat. Chapter 117 and pursuant to its City Charter; and <br /> <br /> WHEREAS, the City has the right to acquire the real property prior to the filing of an <br />award by the Court appointed commissioners, pursuant to Minn. Stat. §117.011 and {}117.042; <br />and <br /> <br /> WHEREAS, the real property which needs to be acquired for the industrial park <br />purposes described above is legally described as follows: <br /> <br />parcel A: <br /> <br />The Southwest Quarter of the Northeast Quarter of Section 28, Township 32, <br />Range 25, Anoka County, Minnesota except the North 150 feet thereof, and Lot 1, <br />AUDITOR'S SUBDIVISION NUMBER 34, Anoka County, Minnesota; <br /> <br />-and- <br /> <br />135 <br /> <br /> <br />
