I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> <br /> I <br />I <br />I <br />I <br />I <br />1 <br />I <br />I <br /> <br />PC CASE #3 <br /> <br />TEMPORARY OUT-OF-CLASS PAY FOR POLICE TECHNICIAN <br /> By: Rhonda Heryla, Human Resource Manager <br /> <br />Background: <br /> <br />Police Records Manager Arlene Stafford began a nine-week absence from work effective January <br />6, 2000. During Ms. Stafford's absence, Police Technician Linda Aaseby was assigned the <br />responsibility of overseeing office operations until the Records Manager returned. As a result of <br />this job assignment, Ms. Aaseby is requesting out-of-class pay in the amount of the annualized <br />starting salary of the Records Manager position until the Records Manager returns to work. The <br />basis for the request is that Ms. Aaseby was assigned to oversee work not normally done by her <br />and she felt there is ample past practice in Ramsey to support this out-of-class pay request. <br /> <br />Considerations: <br /> <br />In order to address the outlined concern, the labor agreement with AFSMCE, the City Code <br />Personnel Policy, and past practices were all reviewed. <br /> <br />Labor Agreement between Ramsey and,4FSCME <br />No provision was found in the agreement addressing out of class pay. Articles 6.1 and 6.2 of the <br />agreement address Employer Authority and state that the employer retains full rights in <br />managing and directing staff unless limited by the agreement. <br /> <br />6.1 <br /> <br />The EMPLOYER retains the full and unrestricted right to operate and manage <br />all staff, facilities, and equipment; to establish functions and programs; to set <br />and amend budgets, to determine the utilization of technology, to establish <br />and modify the organizational structure; to select, direct, and determine the <br />number of personnel; to establish work schedules; and to perform any <br />inherent managerial function not specifically limited by this AGREEMENT. <br /> <br />6.2 <br /> <br />Any term and condition of employment not specifically established or modified <br />by this agreement shall remain solely within the discretion of the EMPLOYER to <br />modify, establish, or eliminate. <br /> <br />City Code Personnel Policy <br />No provision was found in the City Code Personnel Policy regarding out-of-class pay. Section <br />3.20.05, Subdivision 1 of the City Code states that no employee of the City shall receive pay in <br />addition to the authorized salary for the position or positions to which the employee has been <br />appointed nor assigned unless that employee has received prior approval from the Administrator <br />or designee. None was granted in this case. <br /> <br /> <br />
