I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I, <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />i <br /> <br />I <br />I <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 10:00 p.m. <br /> <br />Mayor Garnet suggested a special work session to discuss the issue further. <br /> <br />City Attorney Goodrich nr~ted that another public hearing will be required. <br /> <br />Councilmember Anderson stated that she would be interested in researching if there is any other <br />method of charging for the project other than tax capacity. <br /> <br />Councilmember Hendriksen requested that all of the Councilmembers be given a chance to <br />review all five of the options that were considered for this project.. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to table <br />action until the next public hearing with justification of all five alternatives. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Connolly. Voting No: Nofie. <br /> <br />Case//6: <br /> <br />Request to Renew a Conditional Use Permit for an Asphalt Production <br />Plant; Case of Commercial Asphalt <br /> <br />Community Development Director Frolik stated that on July 12, 1988, the City'of R. amsey issued <br />a conditional use permit to Commercial Asphalt to establish and operate a hot mix asphalt plant <br />south of County Road #116, east of Basalt Street and north of the Burlington Northern Railroad <br />tracks. The conditional use permit expired on January 31, 1995. At the request of the Applicant, <br />the City issued a new conditional use permit to continue the asphalt plant operations on February <br />28, 1995, and the permit will expire on March 1, 2000. Commercial Asphalt submitted an <br />application for a renewal of the permit to continue the plant operations. The Planning <br />Commission and City Council have recently been dealing with the issue of conditional use <br />permits and interim use permits. The amendments to City Code are not complete at this point, <br />but the City Council has directed staff to prepare an ordinance amendment to eliminate the <br />option to place expiration dates on conditional use permits, in accordance with State law. <br />Therefore, the conditional use permit for Commercial Asphalt has been drafted without an <br />expiration date and the conditional use will be in effect as long as there is compliance with the <br />terms of the permit. The Planning Commission conducted a public hearing on February t, 2000. <br />One resident was not protesting the re-issuance of the conditional ~e permit, but noted that the <br />odors generated at the plant are sometimes objectionable when the winds are from the northwest. <br />Brent Schlueter of Commercial Asphalt committed to working with the resident on these <br />occasions. <br /> <br />Councilmember Hendriksen inquired if the Council has the option of denying the permit. <br /> <br />City Council/February 22, 2000 <br /> Page I9 of 27 <br /> <br /> <br />
