Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 00-03- A RESOLUTION APPROVING THE ISSUANCE OF A GRADING PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT WHEREAS, Findings of Fact #~ following conditions. the Ramsey City Council adopted Resolution No. 00-03- adopting for this use and herein approves the Grading Permit subject to the NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On March ~, 2000, a Grading Permit ("Permit") was issued by the City of Ramsey ("City") to North Fork, Inc. ("Permittee") for grading operations on the property legally described as follows: Lots 3 and 4, Block 2, NORTH FORK LAKE ADDITION, Anoka County, Minnesota. This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: 1. This permit shall expire on September 28, 2000. All equipment used for grading operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the worksite regularly. Ail worksites shall be properly safeguarded to prevent the general public from depositing garbage or other refuse on the worksite. 4. Existing tree and groundcover shall be preserved to the extent feasible. Grading operations shall be conducted in such a manner to minimize interference with the surface water drainage outside the boundaries of the operation. No grading operations shall occur at below an elevation of 6 feet above the elevation of the water table on the worksite. Fencing may be ordered by the City Council or City Engineer anytime the permit is in force and shall be installed within 24 hours of written notice. 8. All access roads to and from the Subject Property shall be maintained in order to minimize dust. The maximum slope other than the working face shall be sloped on all sides no steeper than a rate of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working face be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When grading operations are anticipated to be discontinued for an interval greater than one working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical.
