I
I
I
I

City Attorney Goodrich replied that the Council would have to adopt findings of fact in the
negative.

Councilmember Anderson stated that she is' concerned that the area of Commercial Asphalt may
be changing in the near future and thinks there should be an expiration date on the permit of less
than five years.

City Attorney Goodrich replied that staff is working on drafting interim use permits and could
grant a 60-day extension to the applicant.

Mayor Gamec stated that Commercial Asphalt has been a "good neighbor" in the City and
understands the concerns of the Councilmembers regarding the redevelopment of the area, but
felt it would be beneficial to work with them rather than denying the permit at this time.

Councilmember Hendriksen stated that he thinks the business, because of the odors, will have a
negative impact on the Business Park if it is redeveloped.

Gary Sauer, President of Commercial Asphalt, replied that there is no mining being done on the
property. He explained that there were numerous complaints when the plant was located in
Anoka, but noted the Ramsey plant does not operate the same way. They continuously work to
improve the facility. Mr. Sauer stated that they would be willing to do whatever the City wants
including the issuance of a weekly, monthly or yearly permit.

City Attorney Goodrich recommended tabling the item for further information.

Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to table the item
for further information.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson,
and Zimmerman. Voting No: None.

Case #7:

Request for Extension to Record Final Plats for River Pines 3ra and 4th
Addition; Case o fU.S. Home Corporation

Community Development Director Frolik stated that on May 12, 1998, the Ramsey City Council
granted final plat approval to Apple Ridge 2"d, 3~, 4'~ and 5t~' Additions being developed by Good
Value Homes. Subsequently, the property was sold and US Home Corporation, or On-in
Thompson Homes, assumed the obligations of the development agreements. US Home desired a
plat name change and recorded the second phase of Apple Ridge as River Pines. Accordingly the
3rd phase of what was approved as Apple Ridge 3rd Addition is currently in the process of being
recorded as River Pines 2"a Addition. City Code establishes a two year time frame from the date
of final plat approval to record a plat at the County. Therefore, recording time frame for River

City Council/February 22, 2000
