CASE # <br /> <br />I <br />I <br />I <br />I. <br />I <br />I <br />I <br />I <br />I <br /> <br />REQUEST FOR EXCEPTION FROM DEVELOPMENT MORATORIUM; <br /> CASE OF TSM DEVELOPMENT, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />The City currently has a moratorium on the development of certain land use sensitive parcels. <br />The purpose of the moratorium is to protect the planning process related to updating the <br />Comprehensive Plan and provide the City with a sufficient amount of time to adopt official <br />controls to implement the new comprehensive plan. TSM Development has interest in property <br />located in the northeast quadrant of County Road #116 and Ramsey Blvd. N.W. The property is <br />subject ': · the moratorium until February 16, 2001. <br /> <br />In June of 1998, the City received an application from TSM Development and Wayne Johnson to <br />rezone the subject property from Industrial to R-3 Urban Residential. TSM was proposing to <br />develop the property with townhomes and the R-3 zone allows up to 7 units per acre. At that <br />time, the future land use map in the draft comprehensive plan proposed this property for <br />development with mixed residential uses. TSM and Wayne Johnson were advised that the <br />application for rezoning could not be accepted unless the property was excepted from the <br />moratorium. Based on the opinion of Hoisington Koegler Group (HKG), Ramsey's consultant <br />for the comprehensive plan update, the City Council denied the request for exception to the <br />moratorium. Although the townhouse concept appeared to comply with the mixed residential <br />land use in the comprehensive plan draft at the time, the memo from HKG. pointed out that the <br />appropriate densities in tlfis land use category were not yet resolved. <br /> <br />I <br />I <br />I <br /> <br />Somewhere between June and November of 1998, the City Council changed the proposed land <br />use of the subject property in the comprehensive plan draft from Mixed Residential to Urban <br />Rural Residential Transition. <br /> <br />In February of 2000, the City received another application from TSM to rezone the property from <br />Industrial to K-3 Urban Residential. The application was returned to the applicant with an <br />explanation that the property was still subject to a moratorium. <br /> <br />On April 3, 2000, the City received a written request that the property be excepted from the <br />moratorium.
