The current zoning for industrial use would apparently be less <br />harmonious with the City's Comprehensive Plan for property in the area and, as discussed <br />above, would be contradictory to the use proposed by Hoisington Koegler for the updated <br />Comprehensive Plan. <br /> <br />5. That the proposed use/subdivision will be consistent with the intent and purpose of <br />this Ordinance. <br /> <br />TSM's proposed use is consistent with the intent and purpose of the Ordinance. Ordinance <br />No. 99-12 specifically states that its purpose is to protect the planning process and to allow <br />study of certain land use sensitive parcels which are subject to change in the Comprehensive <br />Plan. TSM's original Land Use Application was filed nearly two years ago. Since that time <br />The City of Ramsey and its consultants have had the benefit of more khan twenty-two months <br />to complete its review of the proposed use of the Property, as well as the opportunity to <br />determine the best use of the Property. In this case, the proposed use and the best use, as <br />determined by Hoisington Koegler, are consistent. The proposed re-designation from <br />industrial to R-3 zoning is consistent with the intent and purpose of Ordinance No. 99-12. <br /> <br />In conclusion, TSM requests that the City of Ramsey approve the Land Use Application. <br />TSM asks that the Property be re-designated from industrial to R-3 zoning and that TSM be <br />allowed to propose and gain approval of its Plat. The City's stated purpose in issuing <br />Ordinance No. 99-12 was to allow time to consider whether the proposed use was consistent <br />with the Comprehensive Plan. Moreover, the City's own consultants agree that "It]he <br />proposed residential use of the subject site appears to be consistent with the vision and <br />guiding principles set forth at the beginning of the process for updating the Comprehensive <br />Plan." Over two years have passed since the time of the original Land Use Application.
