Mr. Berkopec stated they have not yet made that decision. He invited all 'to tour their Andover
facility. He stated that use is overcrowded and they have talked for five plus years about the
need for a new facility. He stated if the conditional use permit is not approved, they may
compromise to take this site, or may not, but they would like an accelerated schedule.

Commissioner Johnson stated there has been some inquiry about the use of the old waste
management site. '

Community Development Director Frolik stated it is owned by the PCA who owns the landfill
site and area-" around it. She stated she understands the PCA is still working on the closure
process. She noted the location of another parcel south of the landfill and west of Parabody
which the City was looking at acquiring for the development of another industrial park.

Commissioner Dempsey noted the City had a plan for the development of the area and asked if
this request is at odds with that City plan for the future development of this area.

Community Development Frolik stated she does not have the Comprehensive Plan before her but
this area is targeted for industrial uses.

Commissioner Dempsey read a comment froTM one of the letters and asked if there was some
kind of an overall development plan 'discussed with businesses in regard to the City's intention
for that area.

Community Development Director Frolik stated she is not aWare of any and is only aware of the
Comprehensive Pkan and Land Use Map. She stated mere is a push to improve the aesthettcs and
standards of development.

Commissioner Dempsey asked audience members if they would like to provide comment
relating to how they see this area would develop. He noted that the conditional use permit
request talks about having no mixed solid waste left on the tipping floor over.the weekend,
however, the letter of March 24 from Ace Solid Waste indicates there could be material left on
the floor overnight.

Mr. Berkopec explained they wrote that initial letter before the conditional use permit and list of
conditions was written. He stated they are prepared, as it relates to the storage issues, to live by
the conditions of the conditional sue permit.

I
I
I
I
I
I
I
I
I
I
I
I
I
I

Commissioner Dempsey asked about material remaining in the trucks that arrive late at the
facility.

Mr. Berkopec stated that is related 'tO Phase 1 where the track parking will be set up. He
'.explained that it is not practical to leave material in the trucks overnight because the mechanics
may need to work on the track. Also, the 50 trucks would be parked in a row and if the truck is
loaded and a fire starts, it would quickly spread to the entire fleet. He stated there are practical
business issues which result in the tracks being emptied each night.

Planning Commission/April 10, 2000
