Chairman Anderson noted that part of the reason for the
layout is because of the City Charter, and it meets the intent of the Charter. Commissioner
Johnson commented on the public's interest in this development, and urged those who found the
process interesting to get involved with City boards and commissions. He noted the vacancy on
the Planning Commission and told interested parties to contact Communi¢ Development
Director Frolik. Commissioner Wivoda asked for an update on the process that the developer
must go through from this point. Community Development Director Frolik stated the developer
would need to update the preliminary plat, and the recommendation for the rezoning will go to
the City Council. If approved at the Council level, the developer will need to submit a final plat.

COMMISSION BUSINESS

Case #2: Proposed Ordinance to Amend Size Limits on Attached Garages

Presentation

Chairman Anderson explained that the last time City Code regulations regarding garages and
accessory buildings were amended (1999), City Staff decided to include a size restriction of
1,000 square feet on attached garages. The intent was to prevent situations Where the attached
garage is larger than the home. The Building Official has reported that the new rule is not
working. The Building Department has received at least 3 building permits already for larger
homes that have garages exceeding 1,000 square feet and they do not look odd at all. The City
Council was apprised of the pending building permit applications in conflict with the current
1,000 square foot restriction. The consensus was to process the 'building permits and take
immediate action to amend City Code to go back to the way it was with no restriction on the size
of attached garages. City Staff recommends 'adoption of the proposed ordinance to eliminate size
restrictions on attached garages.

Commission Business

Commissioner Kociscak questioned why the limit was 1,000 square feet in the frrst place.

Community Development Director Frolik stated it was suggested by a staff member when
preparing the ordinance because other communities haVe that limit, and this was just an
oversight. She noted that the size of the lots are larger in rural districts, and there is room to
build larger garages.

Chairman Anderson questioned why the City was so concerned with the size of residents'
garages.

Commissioner Johnson explained that originally there was some concern that people would be
conducting home occupations out of larger garages.

Planning Commission/Ap ril 4, 2000

229
