I I I I I I I I I I' I I I I I I I 79736 WHEREAS the City is about to perform grading, surfacing, storm sewer, utilities and traffic signals construction and other associated construction upon, along and adjacent to Trunk Highway No. 47 from 130 meters north of County State Aid Highway No. 116 to 350 meters north of 153rd Avenue within the corporate City limits in accordance with City-prepared plans, specifications and/or special provisions designated as State Projects No. 0206-50 (T.H. 47=110), No. 02-605-06, No. 199-010-03 and No. 199-10~-05; and WHEREAS the City has requested participation by the State in the costs of the grading, surfacing and storm sewer construction; and WHEREAS the State is willing to participate in the costs of the grading, surfacing and storm sewer construction up to a defined maximum of state funds under State Project No. 0206-50 (T.H. 47=110) as hereinafter set forth; and WHEREAS the State desires that the City will control right-of-way access and the City will idemnify the State relating to the future rights-of-way access control along the east'side of Trunk Highway No. ~7 from 142nd Avenue Northwest to Xklmo Street Northwest as hereinafter set. forth; and WHEREAS the construction engineering will be covered under a seperate agreement between the State and the City; and WHEREAS the traffic control signal system maintenance and other pertinent items will be covered under a seperate agreement between the State and the City; and WHEREAS Minnesota Statutes Section 161.20, subdivision 2 authorizes the Commissioner of Transportation to make arrangements with and. cooperate with any governmental authority 'for the purposes of constructing, maintaining and improving the trunk highway 'system. 2 373
