IMPROVEMENT AHEAD OF SCHEDULF <br /> <br />The Council may give consideration to advancing developer financed improvements <br />subject to the following: <br /> <br />Subd. A. Applicant(s) shall state intention with the petition for improvement and <br /> may include a request for waiver of hearing. <br /> <br />Subd. B. <br /> <br />Council shall refer petition to the City Engineer for feasibility study and <br />report, and shall determine whether or not a pubiic hearing is required or <br />warranted. If a public hearing is required or warranted, the City <br />Engineer shall indicate to Council how long the feasibility report will take, <br />and shall set the public hearing date accordingly. If there is no public <br />hearing, consideration will be given upon submission of the feasibility <br />study and report. <br /> <br />Subd. C. <br /> <br />Council shall consider improvement proposal after receipt of feasibility <br />study and report. If Council approves the proposed improvement, <br />preparation of final plans and specifications will be ordered upon receipt <br />of a security deposit of one and one-half (1¼) times the City Engineer's <br />cost estimate to prepare the plans and specifications, <br /> <br />Subd. D. <br /> <br />Council then shall approve final plans and specifications, order call for <br />bids, receive bids and award contract. Any easements necessary will be <br />so authorized for acquisition by the City Attorney. <br /> <br />SECTION 7. RURAL STREET IMPROV.EMENTS <br /> <br />All new development located outside the MUSA will require to meet the Standard <br />Specifications for Rural Residential Street Construction. <br /> <br />The City shall not construct rural streets under public contract where a new <br />subdivision is being or has been created unless the benefiting property owners <br />petition the City and proceed as authorized by Chapter 429, Laws of Minnesota. The <br />City may,. at its option, consider public contract construction of rural street <br />improvements where an unimproved rural road presently exists. This option shall be <br />exercised on a priority basis with rural roads having the potential to become routes of <br />collector classification or higher, given the highest priority. The second priority will be <br />given to other streets where the best interests of the general public are served. <br /> <br />SECTION 8. NON-MUNICIPAL UTILITIES <br /> <br />Where non-municipal utilities, such as pipelines and electrical lines cross a <br />subdiyJsion, it shall be the responsibility of the developer to pay the costs necessary <br /> <br />5 <br /> <br /> <br />
