~-~ ~: ~J~J~J i,~,'~ ~r~ ~i ~¥ U~- NNDb~JER 76~ ?55 8923 TO 7804014 <br /> <br /> Page 5/8 <br />P, 85/0@ <br /> <br />Thirty (30) days prior to ordering improvements for a proposed <br />subdivision or development, an agreement with the developer which <br />details the nature of the development, the schedule for implementation, <br />the role for the developer, the role ¢ the .City and other affected <br />agencies, and ether items as may be deemed advisable by the City <br />Attorney shall be entered into by the City and developer. The <br />development agreement shall become effective at such time as the <br />Council orders the improvement(s), No improvement shall be ordered <br />without a mutual agreeable agreement in place. <br /> <br />Subd. B. Developer Guarantees <br /> <br />As stipulated In the development agreement, the Developer shall, post <br />with the City surety(les) in a form acceptable to [he City Attorney, and in <br />amounts .approved by the City Bngineer for the following purposes: <br /> <br />1.) Developer's improvements (grading, .lot staking, erosion control, <br /> street lighting, etc.). <br /> <br />2.) <br /> <br />Assessments for Public Improvements: <br />a.) Street Grading and Drainage, <br />b.) Utilities (Sanitary Sewer, Water and Storm Sewer), <br />c.) Street Construction (Concrete Curb and Gutter, Gravel Base and <br /> Bituminous Pavement), <br />d.) Boulevard Restoration. <br /> <br />3.) Relocation and/or Protective Improvements. for Non-Municipal <br /> Utilities (Cash Deposit Only). <br /> <br />4.) Developer-Constructed Public Improvements if so approved by the <br /> City. <br /> <br />SECTION 5. ENGINEERING OPTIONS_AND RESPONSIBILITIES <br /> <br />The City Engineer shall have the option and be responsibf,e for expanding p~tltions to <br />provide for continuity and rational extension of proposed improvements. Whenever <br />this occurs, It shall be brought to the attention of the Council in the feasibility study <br />and report. The Council shall then give consideration to altering the proposed <br />improvement from petitioned improvements 'to Council-Initiated. <br /> <br />In the interests of economy, the City Engineer shall combine like-~pe improvements <br />in developing the final plans and specifications to reduce improvement costs. <br /> <br />4 <br /> <br /> <br />
