(~) <br /> <br />If a system constructed between May 27, 1989 and January 23, 1996, <br />does not comply with applicable requirements, and is not an imminent <br />public health tract, a property owner applying for a zoning permit to <br />construct a bedroom addition has five (5) years from the date of <br />issuance of such zoning permit to bring the system into compliance. <br /> <br />Failing Septic Systems. A notice of noncompliance shall be issued and copies <br />provided to the property owner and the City within 30 days under the following <br />conditions: <br /> <br />(a) <br /> <br />A failed ISTS shall be upgraded, replaced or repaired in compliance with MN <br />Rules Chapter 7080.0060, as applicable within one (1) year of the date of <br />notice of non-compliance. The Department will give consideration to weather <br />conditions as compliance dates are established; <br /> <br />CO) <br /> <br />An ISTS posing an imminent threat to public health or safety shall be <br />upgraded, replaced, or repaired within ten (10) months of the date of notice of <br />non-compliance; <br /> <br />(c) <br /> <br />When the ISTS is determined to be failing at the point of sale or transfer of <br />property; <br /> <br />(d) <br /> <br />The owner(s) shall submit to the Department an acceptable replacement plan' <br />within twenty. (20) days after notification by the Department. The <br />replacement plan shall identify the location and design of the ISTS and a <br />schedule for its replacement. Failure to submit and execute an acceptable <br />replacement plan is a violation of this Section. <br /> <br />The Department may not require re-certification of an ISTS within two <br />(2) years of its certification date provided the system does not fail or <br />become an imminent public health threat or other cause as deemed <br />appropriate by the Department. <br /> <br />Sale or Transfer of Property <br /> <br />(a) A certificate of compliance shall be provided by the seller to the buyer at or <br /> before the closing. <br /> <br />Co) <br /> <br />The certificate of compliance shall be completed by an Inspector and shall <br />indicate that the ISTS is in compliance with MN Rules Chapter 7080 as <br />amended. <br /> <br />(c) <br /> <br />In the event that one of the exemptions listed in Subdivision 8.30.04 d 4 and $ <br />of this Section applies, the certificate must be signed by both parties to the <br />transaction. <br /> <br />(d) <br /> <br />The certificate shall be filed with the Anoka County Auditor along with the <br />Certificate of Real Estate Value. A copy of the certificate of compliance shall <br />also be filed with the Department. <br /> <br />Exempt Transactions. The certificate need not be completed if the sale Or transfer <br />involves the following circumstances: <br /> <br />(a) The tract of land is without buildings or contains no dwellings or other <br /> buildings with plumbing fixtures. <br /> <br />I <br /> <br />i <br /> <br />I <br /> <br />I <br /> <br /> <br />
