I <br />'1 <br /> <br /> I <br /> <br /> I <br /> I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br /> <br /> WHEREAS, the DEVELOPER herein attests to the fact that there are wetlands existing <br />on the Subject Property; and <br /> <br /> WHEREAS, no expenditure of CITY funds, will be made until the City Code escrow <br />requirements have been fulfilled by DEVELOPER; and <br /> <br /> WHEREAS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" <br />Improvements which definition is used herein when reference is made to "Stage I" and "Stage II" <br />Improvements; and <br /> <br /> WHEREAS, the DEVELOPER desires to construct the Stage I and Stage II <br />improvements, except for those Stage II Improvements constructed by the CITY. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />City_ Code Compliance. That the DEVELOPER will develop the Plat in accordance with <br />the City Code, Section 9.50, entitled "Subdivision" <br /> <br />Conformance with Plan. The Plat shall be developed pursuant to the final plat consisting of <br />two (2) sheets, prepared by Hy-Land Surveying, P.A. <br /> <br />Incorporation of All Ci.ty Code Requirements. That the recitals above and the provisions <br />of the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the <br />CITY as amended to date hereof, are incorporated herein by reference. <br /> <br />Future Access West of the Plat. Upon written request from the CITY, the fee title owner of <br />Lot 3 in the Plat herein agrees to convey to the CITY for the sum of One Dollars and No <br />Cents, the 66-foot Drainage and Utility easement which runs from the bulb of the cul-de-sac <br />to the western boundary of the Plat for public road right-of-way purposes. The developer of <br />property beyond the west boundary of the Plat shall be responsible for all costs related to the <br />extension of 178th Avenue N.W. from the cul-de-sac terminus to the west boundary of the <br />Plat with no financial participation on the part of the property owners in the Plat. <br /> <br />Stage I Improvements Required. The DEVELOPER agrees to construct the required <br />Stage I Improvements according to the terms and conditions of this contract and in <br />accordance with DEVELOPERS' plans submitted to the CITY.
