ORRIN THOMPSON <br /> <br />HOMES <br /> <br />Minnesota's Enduring Standard of Value <br /> <br />July l 0, 2000 <br /> <br />Sylvia Frolik <br />Community Development Director <br />City of Ramsey <br />15153 Nowthen Blvd. N.W. <br />Ramsey, MN 55303 <br /> <br />Re: Moratorium Hardship Exception for the Katnis Property <br /> <br />Dear Sylvia, <br /> <br />Orr/n Thompson Homes and Maflene Katnis are formally requesting a Moratorium <br />Hardship Exception for her property generally known as 14660 St. Francis Boulevard <br />NW. Following are the five criteria required to be met by ordinance #99-12 and our <br />explanations for meeting each criterion. <br /> <br />That there are special circumstances or conditions affecting said property_ such <br />that the strict application of the provisions of this Moratorium Ordinance would <br />depr/ve the petitioner of the reasonable use of petitioner's land. The property is <br />zoned for commercial use. The Moratorium was enacted to protect the <br />comprehensive planning process by preventing development during the period the <br />City needed to study the property and adopt its plan. Ms. Katnis has not been able <br />to develop the property for commercial uses regardless of the zoning. The City <br />has updated the Comprehensive Plan, which guides the land as high-density <br />residential development. Ms. Katnis entered into a purchase agreement for the <br />property with Orrin Thompson Homes to develop the land as high-density <br />residential use in accordance with the Comprehenhve Plan. The purpose of the <br />Moratorium has been satisfied. Orrin Thompson has met with staff and neighbors <br />to discuss the concept plan. Orrin Thompson now needs to bring the concept plan <br />fbrward to enable it to develop the property in the reasonably near future. If a <br />Hardship Exception is not granted the project will not proceed at all. The <br />purchase agreement will terminate, and Ms. Katnis will suffer substantial <br />economic injury. Without this exception, Ms. Katnis will be deprived of the <br />reasonable use of the land, because she will be unable to develop the property in <br />the manner provided for by the Comprehensive Plan nor in a manner allowed by <br />the zoning. <br /> <br />That the exception is necessary for the preservation and enioyment of a substantial <br />property .fight of the petitioner.
