ORRIN THOMPSON

HOMES

Minnesota's Enduring Standard of Value

July l 0, 2000

Sylvia Frolik
Community Development Director
City of Ramsey
15153 Nowthen Blvd. N.W.
Ramsey, MN 55303

Re: Moratorium Hardship Exception for the Katnis Property

Dear Sylvia,

Orr/n Thompson Homes and Maflene Katnis are formally requesting a Moratorium
Hardship Exception for her property generally known as 14660 St. Francis Boulevard
NW. Following are the five criteria required to be met by ordinance #99-12 and our
explanations for meeting each criterion.

That there are special circumstances or conditions affecting said property_ such
that the strict application of the provisions of this Moratorium Ordinance would
depr/ve the petitioner of the reasonable use of petitioner's land. The property is
zoned for commercial use. The Moratorium was enacted to protect the
comprehensive planning process by preventing development during the period the
City needed to study the property and adopt its plan. Ms. Katnis has not been able
to develop the property for commercial uses regardless of the zoning. The City
has updated the Comprehensive Plan, which guides the land as high-density
residential development. Ms. Katnis entered into a purchase agreement for the
property with Orrin Thompson Homes to develop the land as high-density
residential use in accordance with the Comprehenhve Plan. The purpose of the
Moratorium has been satisfied. Orrin Thompson has met with staff and neighbors
to discuss the concept plan. Orrin Thompson now needs to bring the concept plan
fbrward to enable it to develop the property in the reasonably near future. If a
Hardship Exception is not granted the project will not proceed at all. The
purchase agreement will terminate, and Ms. Katnis will suffer substantial
economic injury. Without this exception, Ms. Katnis will be deprived of the
reasonable use of the land, because she will be unable to develop the property in
the manner provided for by the Comprehensive Plan nor in a manner allowed by
the zoning.

That the exception is necessary for the preservation and enioyment of a substantial
property .fight of the petitioner. Ms. Katnis has the right to reasonable use and

8421 Wayzata Boulevard, Suite 300 · Golden VaLley, Minnesota 55426
(763) 544-7333 phone-71t- (763) 544-9086 fax
