Mr. Goodrich stated consideration for him signing the purchase agreement is the City would get <br />the right -of- access. We would sell him this piece of land for $50,000 and we would not have to <br />pay anything for the right -of- access. <br />Councilmember Dehen asked how one could bargain when you don't even know what the value <br />of the land is. Someone must have thought the access was equivalent to the value of the <br />property. How can you know that without having some idea what the property is worth. <br />Mayor Ramsey stated he would presume they took the total value of access they wanted on <br />Highway #47 and subtracted that from the amount on the right -of- access. <br />Director of Public Works Olson thought there was discussion of the trail along there as well. <br />Councilmember Elvig remembered the project was tied up by State and Federal too. <br />Motion by Councilmember McGlone and seconded by Councilmember Elvig to introduce the <br />ordinance authorizing the sale of the property legally described in the ordinance and which real <br />property is being platted as Outlot B, River's Bend 5th Addition, Anoka County, Minnesota. <br />Further discussion: Councilmember Wise asked about access onto Highway #47 and Mr. <br />Goodrich responded that we would not allow plats with access. Councilmember Jeffrey asked if <br />by introducing this ordinance, at some point in time are we going to get to talk about the end use <br />of this property. Mr. Goodrich replied that is a zoning issue — not a land sale issue. <br />Councilmember Wise thought the State would allow access onto #47, which Mr. Goodrich <br />replied they would not. He added we promised the State we would not allow any access. We <br />acquired the land and the right -of- access — we did the work and they gave us the money. <br />Councilmember Look stated that regardless of the outcome of this property here, your interested <br />party could go in one of those two lots. Mr. Foster stated he is not sure it's zoned properly. <br />Councilmember Elvig stated we will introduce this ordinance but it does not preclude us from <br />accepting the purchase agreement. Mr. Goodrich stated we have already signed this. <br />Councilmember Look asked Mr. Foster if he is agreeable to somehow making that right from a <br />final standpoint with the City in lieu of the purchase agreement. Mr. Foster replied that's kind of <br />a tough deal, especially when he thought he had a deal. He stated he does not want to be sued <br />and he doesn't know where he is with that. Councilmember Look stated that any sale of property <br />within the City is required by ordinance - that's paramount to any other action that went down. <br />He suggested Mr. Foster's potential buyer should be made aware of that fact. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers McGlone, Elvig, Dehen, and <br />Jeffrey. Voting No: Councilmembers Look and Wise. <br />Mr. Goodrich announced this ordinance would be on the September 14 regular Council meeting <br />for adoption. <br />Consensus of the Council was to direct staff to meet with Mr. Foster and negotiate an outcome. <br />Special City Council — September 7, 2010 <br />Page 3 of 6 <br />
