7. That a conditional use permit for the Applicant was originally approved by the City of <br />Ramsey (the "City ") in November of 1983. <br />8. That the original conditional use permit was voided by the City in 1996 when churches <br />became a permitted use in the residential districts. <br />9. That subsequently, religious institutions were categorized as a conditional use and the <br />church operation became a lawful non - conforming use. <br />10. That per MN Stat. 462 -357 Subd. 1 (e), lawful, non - conforming uses cannot be expanded <br />unless otherwise provided under applicable laws and ordinances. <br />11. That this conditional use permit will once again make the church operation a conforming <br />use. <br />12. That the church operation will not be unduly dangerous or detrimental to persons residing <br />or working in the vicinity of the use, or to the public welfare. <br />13. That the church operation will not substantially adversely impair the use, enjoyment or <br />market value of any of the surrounding properties. <br />14. That the church operation will be maintained so as to be harmonious and appropriate in <br />appearance with the existing or intended character of the general vicinity and will not <br />change the essential character of the area. <br />15. That the church operation will not be hazardous to existing or future neighboring uses. <br />16. That the church operation will not impact essential public facilities and services, such as <br />highways, streets, police and fire protection. <br />17. That the church operation will not create excessive additional requirements at public cost <br />for public facilities and services and will not be detrimental to the economic welfare of the <br />community. <br />18. That the church operation will not involve uses, activities and equipment that will be <br />detrimental to any persons, property, or the general welfare by reason of excessive <br />production of traffic, noise, smoke, fumes, glare or odors. <br />The motion for the adoption of the foregoing findings of fact was duly seconded by <br />Councilmember Wise, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Ramsey <br />Councilmember Jeffrey <br />Councilmember Wise <br />Councilmember Backous <br />Councilmember Elvig <br />Councilmember McGlone <br />Councilmember Tossey <br />Resolution #11 -01 -032 <br />Page 2 of 3 <br />
