Councilmember ~2 introduced the following resolution and moved for its adoption: 00.,0. RESOLUTION AUTHORIZING ACQUISTION OF PERPETUAL AND TEMPORARY EASEMENTS FOR THE CONSTRUCTION OF IMPROVEMENT PROJECT #99-67 (MISSISSISSIPPI RIVER STORMWATER SUBDRAINAGE DISTRICT NO. 1) WHEREAS, the City finds it necessary and in the public interest to construct storm sewer to provide for improved drainage in the Mississippi River Stormwater Subdrainge District No. 1; and WHEREAS, it is necessary to acquire certain perpetual and temporary easements over under across certain real property within the City in order to provide property for the storm sewer construction; and WHEREAS, the City has authority to acquire the real property for the public improvements by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stat. {}117.001 and {}117.042; and WHEREAS, the City finds and declares that it is in the public interest to acquire title to and possession of the easements described herein prior to the filing of an award by the Court appointed Commissioners; and WHEREAS, the property owners of the real property, over, under and across which the easements are necessary which need to be acquired have been identified by the City as follows: PIN 35-32-25-31-0022 35-32-25-24-0001 35-32-25-23-0006 35-32-25-23-0004 FEE OWNER Ramsey Holdings, Inc. Ernest Miller Winslow Holasek Hunter Investment, Inc. WHEREAS, the legal descriptions of the perpetual and temporary easements and all interested persons are identified as to each parcel on attached Exhibit "A" (the "Subject Property'). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. In order to carry out the purposes and objectives described above it is necessary to acquire the Subject Property.
