The acquisition of the Subject Property by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to <br />be necessary. <br /> <br />The City deems it necessary for the reasons set forth above to proceed without delay <br />under Minn. Stat. {}117.042 to pay to the owners or into court a sum of money to <br />serve as compensation to the owners of the Subject Property, which amount shall be <br />equal to Petitioner's approved appraisal of value as determined by the City. <br /> <br />That the City Administrator is hereby directed to acquire the Subject Property as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br />5. That if the Subject Property cannot be acquired by direct negotiation, is shall be <br /> acquired by eminent domain. <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated by the City or Court. <br /> <br />7. The City Administrator is authorized to expend necessary funds for appraisals of <br /> above described Subject Property. <br /> <br />The motion of the adoption of the foregoing resolution was duly seconded by Councilmember <br />~,'~-, and upon vote being taken thereon, the following in favor thereof: <br /> <br />and the following voted against the same: <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />RESOLUTION #00-10- <br />Page 2 of 2 <br /> <br /> <br />
