-128- <br /> <br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #00-11- <br /> <br />A RESOLUTION APPROVING THE IssuANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />MAINTAIN A SECOND DWELLING ON A PARCEL. <br /> <br /> WHEREAS, Mr. and Mrs. Upton have properly applied for a conditional use permit to <br />maintain a Second dwelling on the property generally known as 16101 Ramsey Boulevard and <br />Iegally described as follows: <br /> <br />South 138.4 feet of West 825 feet of Southwest quarter of Northeast quarter <br />Section 15-32-25 as measured along West and South lines thereof excluding road <br />subject to easement of record. <br /> <br />("Subject Property"). <br /> <br /> WtlEREAS, the Planning Commission met on November 6, 2000, conducted the public <br />hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact # , a conditional use permit ("Permit") to maintain a second <br /> dwelling on the Subject Property is hereby granted to'Mr, and Mrs. Upton ("Permit-tees"). <br /> <br />The second dwelling shall not be discontinued as an accessory use to the principal dwelling <br />by way of sale, lease, or use by other than a relative of the Permit-tees and a relative is defined <br />as someone who is related b'y blood, marriage, or adoption to the Permit-tees, unless the <br />property is subdivided in accordance with relevant City Codes. <br /> <br />The Permittees shall obtain a Certificate of Occupancy for the second dwelling on the Subject <br />Property. The Building Official will conduct the appropriate inspections of the second <br />dwelling to insure the structure meets Uniform Building Code requirements, prior to <br />occupancy. <br /> <br />The Conditional Use Permit upon writ-ten notice being provided by the City to the Permitees' <br />but without further action by the Planning Commission or City Council, shall expire if the <br />permit holder fails to initiate such conditional use permit and fulfill each and every condition <br />attached thereto within one (1) year from the date of its authorization, or if the use is <br />discontinued for a continuous twelve (12) month period, unless a petition for an extension of <br />time in which to complete or utilize the use that has been granted by the Council. Such <br />extension shall be requested in writing and filed with the City at least thirty (30) days before <br />the expiration of the or/ginal conditional use permit.
