The exact location of these items <br />on the Site shall be as directed by the City's Fire Chief. The Permit-tee herein agrees to post <br />"no parking" along private streets in accordance with the instructions of the Fke Chief/public <br />Works Director. <br /> <br />LIGHTING. Any lighting installed on the Site is subject to Prior approval by the City <br />Engineer. <br /> <br />BUILDING FACADE. The Permittee agrees to construct the Structures of maintenance- <br />free siding and asphalt shingles in accordance with the Building Elevations prepared by <br />James Nelson McKellin III dated September 25, 2000. <br /> <br />RECREATIONAL AREA. The Permit-tee herein agrees that the size and design of the <br />playground area shall be subject to the approval of the City. It is further agreed that the <br />Permittee will construct a sidewalk parallel to the east/west street entering the subject area <br />and provide a crosswalk across the north/south street 'to link the sidewalk with the <br />playground area. The Permittee shall be responsible for the perpetUal. maintenance of the <br />playground. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT. No building permits for the Site will be <br />issued until the Permittee has: a) signed this Development Permit; b) all financial obligations <br />related to this permit have been fulfilled; c) the plat of Sunwood Estates has been recorded at <br />Anoka County; and d) a variance to the rear yard setback and garage requirement has been <br />obtained from the Board of Adjustment. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall <br />be completed before December I, 2001. <br /> <br />STORMWATER MANAGEMENT FEE. The CITY has enacted a Stormwater <br />Management Fee in the amount of $366.00 per lot/unit. A cash payment in the amount of <br />Eleven Thousand Three Hundred Forty Six Dollars and no cents ($11,346.00) (31 x $366.00 <br />per lot) is due at the CITY prior-to releasing the plat for recording. <br /> <br />ESCROW FOR REQUIRED IMPROVEMENTS. In order to ensure the installation of the <br />Required Improvements in accordance with City specifications and in a timely manner, the <br />Permittee shall be required to deposit with the City a cash escrow or letter of credit, approved <br />as to form by the City, in the amount of forty thousand dollars ($40,000) which is 150% of <br />the City's estimated cost of the Improvements. Prior to the issuance of the building permit, <br />all financial guarantees must be provided as required herein. <br /> <br />Upon completion of the construction of the Required Improvements, the financial guarantee <br />shall be returned to the Permittee and the Permittee shall be required to provide the <br />landscaping maintenance guarantee described in Item #14 of this Development 'Permit. The <br />determination of completion of the construction of the Required Improvements shall be made <br />by the City Council after consultation with the City Engineer.
