Development: <br /> Partnership: <br /> <br />Anoka County Community Action Program, Inc. (ACCAP) <br />Ramsey <br />Ramsey Townhomes <br />A Minnesota limited partnership formed to own the Development <br /> <br />For consideration heretofore acknowledged the Developer agrees as follows: <br /> <br />Development: <br />D1. The development will consist of no more than 28 townhome units. <br />D2. The units will be developed at an approximate cost of $140,000 per unit. <br />D3. ACCAP will construct a play area onsite at a cost of at least $30,000. <br />D4. The Developer consents to the use Of a PUD. <br /> <br />Manaqement Commitments: <br />M1. No more than 25% of the two and three bedroom units will be occupied by very Iow ncome <br />families, defined as having incomes at or below the poverty level for their family size. <br />M2. ACCAP will screen all applicants. Any applicants found to have serious criminal records (a <br />crime that is recent or repeated or relevant to the property and safety concerns of the residents of <br />the City) will not be accepted. Any residents that commit serious criminal acts while residents wilt <br />be evicted. ACCAP's screening will also look for other potential problems, and we will not accept <br />applicants that have previous behavioral and non-financial lease violations that would affect their <br />likely compliance with our lease rules. <br />M3. ACCAP will participate in ongoing neighborhood meetings that are intended to involve the <br />neighborhood and residents in the management of the Development and resolve any problems. <br />M4. ACCAP will respond to neighborhood concerns and iSsues raiSed about. residents of the <br />Ramsey Townhomes. ACCAP will resolve such concerns, if necessary, through the timely eviction <br />of residents. <br />M5. ACCAP will be responsible for the exterior maintenance of the Ramsey Townhomes: trash <br />removal, all landscaping, litter, junk and unlicenced vehicles, etc. ACCAP will inspect the interior <br />of each unit at least once a year and correct any maintenance and housekeeping problems in a <br />timely manner. <br />M6. ACCAP will employ a manager that will live onsite (resident manager). <br /> <br />The Developer agrees that if the Devel~)'per is not complying with the Management Commitments <br />outlined above and as otherwise agreed to by the Developer and the City, the-City has the right <br />to replace the Developer as the property manager of the Development with another professional <br />property manager subject to the approval of the loan and equity partners of the Partnership and <br />at the same management fee that ACCAP is charging the Partnership. The process for said <br />replacement will be as follows: City staff shall conduct a review and if advisable will refer the matter <br />to a committee consisting of a City staff person, a City police officer, and a representative from <br />ACCAP. A majority vote of the committee shall result in a determination to search for and select <br />a replacement property manager. The committee shall select by majority vote a replacement <br />property manager that will be recommended to the lenders and equity partner of the pa~nership <br />and unless objected to in writing shall replace the Developer as property manager. <br /> <br />-205- <br /> <br /> <br />
