2. Density Transitioning requirements can be waived in situations where the owners <br /> of adjacent properties, where density transitioning would apply under this section, <br /> with development interests can agree that the requirements contained in this <br /> section are impractical. Waiver of these requirements would allow development <br /> to occur in a manner consistent with the provisions applicable to the zoning of <br /> . that property. Upon agreement to waive density transitioning requirements, the <br /> owners shall provide an agreement signed by each party to be witnessed,notarized <br /> and filed with the City. <br /> <br />Subd. 3. Tiering Requirement <br /> <br />a. General Requirement. Transitioning under this section is achieved through <br /> "tiering" of lot sizes in a proposed residential deVelopment as described in Subd. 2. If <br /> the City determines that tiering is not achievable because 1) of the proposed housing <br /> types, or 2) the site dimensions will not allow7 for reasonable tiering, then landscape <br /> buffering, described beloTM shall be used to accomplish Transitioning. Residential <br /> developments that are required to provide Transitioning may not achieve the <br /> maximum allowable density as otherwise permitted in the applicable zoning district. <br />b.. Lot Size Tiering. Lot size tiering is a transition technique used to buffer proposed <br /> residential developments from adjacent residential uses. Tiering means a row or <br /> group of lots. The first tier commences at the p~rimeter of the subject property and <br /> the second tier commences at the exterior boundary of the first tier. Upon satisfaction <br /> of the first and second tiering requirements, the minimum lot size for the applicable <br /> zoning district shall be permitted for the remainder of the subject property. <br /> <br />Density Transition Tiers Corresponding Lot Size <br />First Tier <br /> <br />Second Tier <br /> <br />Lot size is to match the adjacent lots <br />but in no case shall a lot be required <br />to exceed 1 acre in size <br />50% of 1s' Tier lot size <br /> <br />Co <br /> <br />Alternatives To Tiering. Either of the four alternatives described below may be <br />used as an alternative to lot size tiering when lot size tiering has been determined <br />unfeasible by the City. The City may permit any one of the natural features described <br />below to be used to buffer existing single family residential development from <br />proposed residential development with higher densities when lot size tiering is not <br />feasible. -- <br /> <br />Natural Features: <br /> <br />(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />Existing topographical features such as, but not limited to, sig~fificant <br />changes in elevations. <br /> <br />Existing vegetation <br /> <br />Wetlands, lakes and rivers <br /> <br />December 12, 2000 Revision <br /> -307- <br /> <br /> <br />
