E. The performance of the Contract shall be done by the Contractor with forces which are adequate to <br /> insure the satisfactory collection and disposal of the recyclable materials at atI times. Contractor's failure <br /> to perform shall not be excused by adverse conditions o£ weather, breakdown and s/miler hindrances which <br /> on or. her work might be regarded as "acm of providence". <br /> <br />F. The Contractor shall certify that the materials collected in the recycling project are delivered to a <br /> recycling processing center. Materials found to be Iandfilled will be in violation of City ordinance and will <br /> cause the Contractor to incur the penalties listed in the City's recycling ordinance. <br /> <br />SECTION 8. <br /> <br />COMPENSATION <br /> <br />The City will compemate the Contractor for the collection of recyclable mater/als from City residents a sum <br />equivalent to $1.56 per mor~th for each residence located within the City during the fa'st year of the Contract. The <br />City will compensate the Contractor for the collection ofrecyclable materials from City residents a sum equivalent <br />to $1.66 p~r month for each residence located within the City during the second year of the Contract. The City <br />will compensate the Contractor for the collection of recyclable materiats from City residents a sum equivalent to <br />$1.78 per month for each residence located within the City during the third year of the Contract. The City will <br />compensate the Contractor for the collection of c[othes/textiles from City residents a sum equivalent to $.06 per <br />month for each residence located within the City when said service is Lmplemented as referenced under Section 3. <br /> <br />SECTION 9. <br /> <br />FILING OF REPORTS <br /> <br />A. The Contractor shall submit a monthly summary describing the residents' participation rate, the quantity <br /> and kinds of all recyclable materials collected and the primary purchaser(s) of the recyclable materials. <br /> ~vfonthly summaries shall bc submitted no later than the 15t. h day of the month following the month for <br /> which the report is submitted. <br /> <br />B. The Contractor shall furnish to the City throughout the term of this Contract a quarferly report detailing <br /> the t/roe expended to complete the Recycling Project. <br /> <br />I <br />I <br />I <br />I <br />I <br /> I <br />.I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />SECTION <br /> <br />ACCESS TO RECORDS <br /> <br />The Contractor shall permit the City to review its books, documents, papers and records which are directly related <br />to the performance of this Contract for the purpose of making an audit, and other examinations deemed necessary <br />by the City. <br /> <br />-22- <br /> <br />SECTION 11. ExfSBYL-kNCE <br /> <br />Pr/or to the commencement of [his Contract, the Contractor shall furnish the City with certificates or copies of the <br />following policies of insurance, approved by the City Administrator, showing that such insurance is in force.
