I <br />I <br />I <br />I <br />! <br />I <br />I <br />! <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE # <br /> <br /> ADOPT ORDINANCE TO REPEAL ORDINANCE 95-12 AND VACATE <br /> DRAINAGE AND UTILITY EASEMENTS IN <br />NORTHFORK HIGHLANDS ADDITION; CASE OF NORTH FORK, INC. <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />][n 1995, the Ramsey City Council approved reducing ~the area of the drainage' and 'utility <br />easement in the rear yards cf Lots 10 and 11, Block 1, Northfork Highlands Addition. The <br />ordinance was never properly recorded. In 1996,' there was an administrative subdivision to <br />realign the common property lines between Lots 11, 12 and 13 of Block 1 in Nortlffork <br />Highlands Addition. This realignment of property lines changed the legal description of Eot 11.. <br /> <br />When North 'Fork attempted to do some follow up and record the easement vacation of 199.5, the <br />ordinance was rejected by the County because the legal description was not current with the <br />administrative subdivision that took place in 1996. <br /> <br />City Council adopted Resolution #00-05-121 in May of 2000 authorizing staff to correct the <br />legal description in the 1995 easement vacation, ordinance. This was done and there was still an <br />error in the legal description and the County rejected it again. In addition, Staff and the applicant <br />also determined that in conjunction with the 1996 administrative subdivision, the standard <br />drainage and utility easements along the common property lines of Lots 11, 12 and 13 were not <br />vacated and replaced along the new common property lines. <br /> <br />Observations: <br /> <br />On December 12, the City Council introduced an ordinance to repeal Ordinance #95-12 and also <br />rescinded Resolution #00-05-121 that modifies the legal description contained in Ordinance #95- <br />12. The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map showing easements to be vacated and easements to be dedicated <br />Proposed legal descriptions for replacement easements <br />Proposed. or~.dinance to repeal 95-12 and vacate easements <br /> <br />Recommendation: <br /> <br />In accordance with the City Charter, the ordinance to repeal Ordinance #95-12 'and vacate certain <br />drainage and utility easements in Northfork Highlands is now eligible for adoption. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #00- <br />Highlands Addition. <br /> <br />to vacate certain-drainage and utility easements in Northfork <br /> <br />Reviewed by: <br />City Engineer <br />City Attorney <br /> <br />CC: 12/19/00 <br /> <br /> <br />
