within the easement area of the road right of way. Wherever possible, placement of <br />the sidewalk within the easement area should allow for a minimum of one foot (1') <br />separation between the edge of one side and the residential property line. The <br />sidewalk shall be constructed as a Stage I improvement. Cost of sidewalk <br />construction shall be borne by the developer and not eligible for credit against park <br />and trail dedication fees. The design must meet current standards of the City, <br />comply with the Americans for Disabilities Act (ADA), and be shown on the <br />preliminary plat for approval. <br /> <br />SECTION 3. MAINTENACE <br /> <br />The City Council annually shall determine the level of snow removal required of adjacent <br />homeowners and to provide for the establishment of a fund to allow for repair or replacement of <br />damaged sidewalks in the future. <br /> <br />SECTION 4.
