13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />Prior to commencing any grading operations, a cash escrow or letter of credit approved as <br />to form by the City in the amount of Ten Thousand Dollars and no cents ($10,000.00) <br />shall be deposited with the City. This financial guarantee may be used by the City to pay <br />for the cost and expense of repairing any public fight of ways or regrading and stabilizing <br />eroded areas due to the grading operation, pay for any cost associated in administering <br />the requirements of this Chapter of the City Code, and to pay for any restoration of- the <br />work site not properly restored apon completion. The Permit Holder agrees to permit <br />access to the property by the City to facilitate restoration, if necessary. <br /> <br />The Permit Holder shall implement sediment and erosion control practices. No g~ading <br />activity shall occur within twenty-five (25) feet of a property. Iine unless silt fence is <br />placed along the property line to prevent sediment from washing onto the adjoining <br />property. Any erosion which causes gullies of geater than one (1) foot within twenty- <br />five (25) feet of a property line shall be regraded w/thin forty-eight (48) hours of the <br />precipitation event that caused the erosion. <br /> <br />The stockpiling of excavated materials and brush piles shall be as shown on Exhibit A <br />and page 4 of the 'Information for Conditional Use Permit' submitted by the Permit <br />Holder. <br /> <br />The Permit Holder shall file with the City a liability insurance policy or certificate of <br />such insurance acceptable to the City and issued by an insurance company authorized to <br />do business in the State of Minnesota. <br /> <br />The policy shall insure the permit holder for the sum of at least $300,000 for injury to one <br />person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />Said policy shall be for the full per/od of the permit and shall provide for-the giving of 10 <br />days prior notice to the City by registered mail of termination, cancellation or amendment <br />of the policy. <br /> <br />In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this <br />item is obtained and filed with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the work site shall be within the limits set <br />by the Minnesota Pollution Control Agency and the Environmental Protection Agency of <br />the United States. <br /> <br />No materials, either brush or export topsoil material, shall be stockpiled within any utility <br />easement or within 75 feet of any overhead power lines. <br /> <br />RESOLUTION #97-09-286 <br /> Page 4 of 7 <br /> <br /> <br />
