home on Lot 9, Block 1, by Orrin Thompson, which was two feet lower than the approved <br />grading plan. An alternative grading plan was presented by Orrin Thompson on October 7, 1999. <br />The plan was reviewed by both Staff and an independent consultant and found to be both <br />deficient and incomplete. The Committee asked that 1) Orrin Thompson be requested to <br />resubmit a plan correcting the deficiencies and omission; 2) That this information be reviewed <br />by an independent engineer, Hakanson Anderson Associates; and 3) That no building permits be <br />allowed until a revised plan has been approved and an escrow had been deposited with the City <br />in the amount of 150% of the estimated construction cost of the remedial work. <br /> <br />Director of Public Works Kapler noted that he spoke to Bill Pritchard of Orrin Thompson Homes <br />and explained that they are in the process of revising the plan and will meet with the affected <br />homeowner this week. They requested that the City pursue information as to what the cost of the <br />project will be so that they can forward a letter of credit or money for escrow. <br /> <br />Councilmember Zimmerman requested that the residents be invited to attend the next Public <br />Works Committee meeting as well as a representative of On:in Thompson Homes. <br /> <br />Councilmember Hendriksen stated that there are two very serious issues with the development, <br />including what he refers to as the "crater". He thinks the City has justification for withholding <br />building permits and questioned if the way the property sits is what is included in the mining and <br />grading permit. <br /> <br />Director of Public Works Kapler replied that City Engineer Jankowski has not been able to <br />review the mining and grading permit. He suggested bringing in Hakanson Anderson as an <br />outside opinion to determine how much it exceeds the mining and grading permit. <br /> <br />Councilmember Hendriksen replied that Mr. Kapler's suggestion was a great idea because the <br />City needs to be prepared to defend the decision if they decide to deny the petition based on past <br />performance. <br /> <br />Councilmember Connolly noted that the Committee requested that a snow fence be placed <br />around the area for safety reasons. <br /> <br />3) <br /> <br />Consider Acquisition of Right-of-Way for Barium Street Extension from Willow <br />Ridge to 153ra Avenue <br /> <br />Councilmember Zimmerman stated that the discussion of the right-of-way for Barium Street <br />extension from Willow Ridge to 153ra Avenue was promoted by a letter from Rademacher <br />Companies. The Committee suggested that Staff meet with Rademacher to discuss their <br />expectations for compensation, as well as ancillary issues as the use of the severed 0.9-acre <br />parcel, which would be created east of the Barium Street extension. <br /> <br />City Council/October 26, 1999 <br /> Page 13 of 16 <br /> <br /> <br />
