CASE <br /> <br />REVIEW URBAN SIDEWALK AND TRAIL ORDINANCE <br /> By: Mark Boos, ParksFtJtilities Supervisor <br /> <br />Background: <br />At the December 20, 1999 Planning Commission meeting, the subject of road right-of-way <br />sidewalk or trail siting within urban residential subdivisions was discussed. There was general <br />consensus that specifics with regard to when they were necessary and who constructs them is in <br />order. <br /> <br />At the January 13, 2000 Park Commission meeting, the Commission approved a draft resolution <br />that addressed sidewalk/trail siting and construction responsibility. It was acknowledged that a <br />resolution may be adequate to define this policy until the terms could be incorporated into City <br />Code. Staff is recommending, however, that an ordinance may be more effective because the <br />review and changes to the subdivision chapter of City Code, based on the amended <br />Comprehensive Plan, may take many months to complete. Further, an ordinance puts <br />prospective developers on notice of their obligation and is less subjective than a resolution. <br /> <br />Observations: <br />The purpose of this case is for the Planning Commission to provide comment on the draft <br />ordinance. An excerpt of City Code, as it is proposed to be amended, is enclosed. The <br />amendment is shown in bold print. A copy of the proposed ordinance to implement the <br />amendment is also enclosed.
