CC Regular Session <br />Date: 04/12/2011 <br />By: Chris Anderson <br />Community Development <br />Item #: 5. 6. <br />Information <br />Title: <br />Request for an Amendment to the Conditional Use Permit to Operate a Religious Institution in the R-1 Residential <br />District (Rural Developing) Located at 5730 179th Lane NW; Case of Cross of Hope Lutheran Church <br />Background: <br />On January 25, 2011, the Ramsey City Council approved a Conditional Use Permit (CUP) for Cross of Hope <br />Church to operate a religious institution on a residentially zoned property. Term #5 of the approved CUP specified <br />that no external activities, other than vehicles coming to and from the property, shall occur before 6:00 a.m. or after <br />8:00 p.m. <br />On March 17, 2011, City Staff received a letter from Pastor Fred Hanson with Cross of Hope Church requesting <br />that this term be amended to a later time in the evening. Per Pastor Hanson's correspondence, it is not uncommon <br />for kids to be outside, especially during warmer months, playing games and/or enjoying a recreational fire beyond <br />8:00 p.m. and he didn't want that to create any potential difficulties with the CUP. <br />Notification: <br />Observations: <br />The term in the approved CUP was intended to address larger, organized events; not to prevent what would <br />generally be perceived as typical uses commonly occurring in residential neighborhoods. Additionally, all external <br />activities on the property would still be subject to the regulations in City Code Chapter 30 (Nuisances) related to <br />noise. Furthermore, organized events that may employ the use of amplified sound (music) or larger gatherings <br />would be subject to a special event permit as well. <br />Recommendation: <br />City Staff recommends amending term #5 of the CUP to allow for external activities on the property to occur <br />between the hours of 6:00 a.m. and 11:00 p.m. <br />Funding Source: <br />All costs associated with reviewing the application are the responsibility of the Applicant. <br />Council Action: <br />Motion to adopt Resolution # amending the terms of the conditional use permit relating to the operation of a <br />religious institution in the R-1 Residential district to allow external activities to occur on the property between the <br />hours of 6:00 a.m. and 11:00 p.m. <br />-or- <br />Motion to deny the requested amendment to the conditional use permit. <br />
