Board Member Brauer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-08-194 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0654 RELATING TO A REQUEST <br />FOR A VARIANCE TO SIDE YARD SETBACK REQUIREMENTS. <br /> <br /> WHEREAS, Robert and Martina Wallace, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 and 9.20.11 of the Ramsey City Code to <br />construct an accessory structure in excess of sixteen (16) feet in height and to encroach into the <br />side yard setback for accessory structures on the property generally known as 5941 143ra Circle <br />NW and legally described as follows: <br /> <br />Lot 10, Block 1, Chestnut Hill, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on August 7, 2003, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned R-1 Single Family Residential, is located inside the 2020 <br /> Metropolitan Urban Service Area, and is approximately 0.37 acres in size. <br /> <br />3. That the Subject Property is surrounded by properties zoned R-1 Single Family Residential. <br /> <br />4. That Section 9.20.11 of the Ramsey City Code states that the side yard setback for comer lots <br /> is thirty (30) feet. <br /> <br />5. That there is an existing garage on the Subject Property totaling 746 square feet. <br /> <br />6. That the proposed structure will be 742 square feet in size (resulting in a total of 1,488 square <br /> feet of accessory structures on the property). <br /> <br />7. That the allotted square footage for accessory structures for the Subject Property is 1,488. <br /> <br />8. That the principal structure on the Subject Property is approximately 20 feet from the side <br /> property line. <br /> <br />9. That the Applicants are proposing to construct an accessory building that will be twenty (20) <br /> feet from the property line. <br /> <br />10. <br /> <br />That the Applicants want to construct the proposed accessory structure in accordance with the <br />twenty (20) foot setback that was in place when the principal structure was constructed in <br />1993. <br /> <br /> <br />
