11. That in 2002, the City Code was amended to increase the setbacks on a comer lot to thirty
(30) feet.

12.

That the Applicants have stated that the detached accessory building will not have a paved
access to Potassium St NW as City Code currently restricts parcels in the 2020 MUSA to one
(1) driveway and the Subject Property has an existing access on 143rd Circle.

13.

That in accordance with City Code, the proposed building will be constructed of materials
similar to that of the home including maintenance free vinyl siding and shingles matching
those of the home.

14. That there is sufficient area on the Subject Property to construct the accessory structure in
accordance with the current side yard setback for comer lots.

15. That the variance requested is the minimum variance which would alleviate the hardship in
regard to the side yard setback requirement.

16. That if granted, the variance will not impair an adequate supply of light and air to adjacent
property.

17. That if granted, the variance will not have the effect of allowing a use that is prohibited in the
applicable zoning district.

18. That if granted, the variance will not impair established property values within the
neighborhood.

19. That the increased height will be compatible with the principal building on the same parcel.

20. That the increased height will be compatible with existing development in the immediate
neighborhood.

21. That if granted, the variance will not unreasonably increase the congestion in the public
street.

22. That if granted, the variance will not increase the danger of fire or endanger the public safety.

23. That if granted, the variance will not violate the intent of the Comprehensive Plan.

24. That, if granted, the variance will not grant the Applicant any special privileges that are
denied to other owners of land in the same district.

The motion for the adoption of the foregoing resolution was duly seconded by Board Member
Watson, and upon vote being taken thereon, the following voted in favor thereof:

Acting Chairperson Johnson
Board Member Brauer
Board Member Watson
Board Member Shepherd

RESOLUTION #03-08-194
