Mayor Gamec introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION 03-07-181 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0652 RELATING TO A REQUEST <br />FOR AN EXTENSION TO THE CONDITIONAL USE PERMIT ISSUED TO SAINT PAUL <br />TERMINALS INC. FOR A RECYCLING FACILITY (PERMIT HOLDER). <br /> <br /> WHEREAS, the City of Ramsey received a letter from Bradley Martinson of Bradley J. <br />Martinson Law Offices, who represents St. Paul Terminals Inc., requesting an additional extension to <br />the conditional use permit issued to St. Paul Terminals, Inc. for a Recycling Facility on the property <br />generally known as 14050 Basalt Street N.W. and legally described as follows: <br /> <br />Lot 1 and Lot 2 (except the south 30 feet of Lot 2), Block 4, Gateway North Industrial Park <br />Plat 2, County of Anoka, State of Minnesota <br /> <br />(the "Subject Property) <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, AS FOLLOWS: <br /> <br />That Section 9.03.04 of the Ramsey City Code states that a conditional use permit shall <br />expire if the permit holder fails to initiate such conditional use permit and fulfill each and <br />every condition attached thereto within one (1) year from the date of its authorization, or if <br />the use is discontinued for a continuous twelve (12) month period, unless a petition for an <br />extension of time in which to complete or utilize the use that has been granted by the <br />Council; and <br /> <br />That on June 26, 2001, the Ramsey City Council (the "City") adopted Resolution #01-06-240 <br />adopting Findings of Fact #0562 and Resolution #01-06-241 approving the request for a <br />conditional use permit to establish a recycling facility on the Subject Property. <br /> <br />o <br /> <br />The City of Ramsey received a letter from the Permit Holder's representative, Bradley <br />Martinson of Bradley J. Martinson Law Offices, dated March 20, 2002, in which it is stated <br />that due to economic conditions the Permit Holder has not been able to initiate the <br />conditional use permit and therein requests an extension of time. <br /> <br />4. The Planning Commission reviewed the request for extension of conditional use permit on <br /> May 2, 2002 and recommended City Council approve the conditional use permit request. <br /> <br />That on May 28, 2002, the City Council adopted Resolution #02-05-115 approving a one - <br />year extension to June 26, 2003 for St. Paul Terminals to implement and fulfill the <br />requirements of the conditional use permit. <br /> <br />That on April 20, 2003 the City of Ramsey received a letter from the Permit Holder's <br />representative, Bradley Martinson of Bradley J. Martinson Law Offices, requesting an <br />extension to the conditional use permit issued to St. Paul Terminals, Inc. <br /> <br /> <br />
