Motion by Board Member Watson, seconded by Board Member Brauer, to approve the following <br />minutes as presented: <br /> <br />1) Board of Adjustment public hearing and regular meeting minutes dated July 10, 2003. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Johnson, Board Members Watson, Brauer, and <br />Shepherd. Voting No: None. Absent: Chairperson Nixt, Board MemberVan Scoy. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Side Yard Setbacks and Height Requirements; <br />Case of Robert and Martina Wallace <br /> <br />Presentation <br /> <br />Assistant Community Development Director Patrick Trudgeon advised this is a request for a <br />variance for the height of an accessory structure and to the side yard setback. He indicated <br />according to City Code, on parcels less than two and a half acres in size, accessory structures are <br />limited to a maximum height of sixteen feet. He further advised City Code requires a 30-foot <br />side yard setback on comer lots for both principal and accessory structures. He explained that <br />when the applicants' home was constructed, the side yard setback for comer lots was 20 feet. <br />The applicants are proposing to construct an accessory structure in such a manner as to maintain <br />the same side yard setback as their home as well as the home on the adjoining property to the <br />north. He advised the applicants are also proposing to construct the accessory structure at a <br />height of sixteen and a half feet, measured at the mean gable height of the roof. <br /> <br />Assistant Community Development Director Tmdgeon indicated Staff is recommending approval <br />of a variance to the height restriction only. They were unable to determine a hardship on the lot <br />that would necessitate a variance to infringe on the side yard setback and therefore are <br />recommending denial of a variance to the side yard setback for a comer lot. He added moving <br />the accessory structure to a 30-foot setback does not appear to affect any trees or wells. He noted <br />they have Findings of Fact for each, with a Resolution to approve the height variance and deny <br />the setback variance. <br /> <br />Public Hearing <br /> <br />Robert Wallace, 5941 143rd Circle, indicated the height request is for 16.5 feet, which they need <br />in order to park their RV in the building. <br /> <br />Acting Chairperson Johnson indicated height does not seem to be an issue. <br /> <br />Mr. Wallace indicated by moving it to 20 feet it will be flush with our house and the neighbors <br />house.
