Board Member Brauer asked if the structure could be constructed at 30 feet to meet the City <br />Code. <br /> <br />Martina Wallace indicated it could, noting they would have to move trees either way. She stated <br />they just felt it would look better if it were flush with the house. <br /> <br />Acting Chairperson Johnson stated it was really the City's code change that necessitates the <br />variance. <br /> <br />Assistant Community Development Director Trudgeon indicated that was correct. He stated the <br />code was changed just last year. <br /> <br />Board Member Brauer asked how long the Wallace's have lived in this location. <br /> <br />Mr. Wallace stated 10 years. He indicated they were the original owners. <br /> <br />Assistant Community Development Director Trudgeon noted they went to 30 feet for uniformity, <br />and it appears they have room to meet this. He reiterated they were hard pressed to come up with <br />Findings of Fact to grant the hardship. <br /> <br />Board Member Watson indicated this is close to his house, and he cannot object. He cannot see <br />it being an issue to grant the setback variance. <br /> <br />Motion by Board Member Brauer, seconded by Board Member Shepherd to close the public <br />hearing at 7:14 p.m. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Johnson, Board Members Brauer, Shepherd, <br />and Watson. Voting No: None. Absent: Chairperson Nixt, Board Member Van Scoy. <br /> <br />Assistant Community Development Director Trudgeon indicated on the Findings of Fact, Item #6 <br />on page 9 says 648 square feet. The applicant would like to make the building two feet wider, so <br />that should be changed to 742 square feet, with a total square footage on the property of 1488 <br />square feet. <br /> <br />Motion by Board Member Brauer, seconded by Board Member Watson to adopt Resolution//03- <br />08-192 adopting Findings of Fact//0653 relating Robert and Martina Wallace's request for a <br />variance to accessory structure height restrictions on the property located at 5941 143rd Circle <br />NW, with a change to the square footage to 742 sqUare feet, and 1488 square feet total on the <br />property. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Johnson, Board Members Brauer, Watson, and <br />Shepherd. Voting No: None. Absent: Chairperson Nixt, Board Member Van Scoy. <br /> <br />Board Member Brauer indicated since there seems to be a consensus on approving both <br />variances, he wondered if they could incorporate them into one instead of doing two variances. <br /> <br />Board of Adjustment/August 7, 2003 <br /> Page 3 of 5 <br /> <br /> <br />
