Presentation
Associate Planner Geisler advised the City has received an application from Michael St. Hilaire
for a conditional use permit to exceed the detached accessory building size restrictions
established in City Code on the property located at 6251 169th Lane NW. She stated the subject
property is approximately 1.75 acres in size, and City Code restricts accessory buildings to 1,664
square feet on parcels this size. She indicated the applicant is proposing to construct a detached
garage that would be 1,200 square feet. Based on the existing accessory square footage, the new
building would exceed the allowable total for the parcel by 352 square feet. She stated the
applicant is requesting the additional square footage to construct a building to store personal
property.

Associate Planner Geisler further advised the proposed detached accessory building will comply
with all of the setback requirements and accessory structure height restrictions established in City
Code. The applicant is proposing aluminum or hardboard siding for the structure to match the
color of the house, which is hardboard siding with brick detailing. She explained that code
violations relating to unlicensed and/or inoperable vehicles and other outdoor storage have
occurred on the property in the past, and in light of this fact, staff recommends granting the
request for additional storage.

Public Hearing
Michael St. Hilaire indicated he was handed the revised resolution when he arrived, and is
unhappy with the addition of condition 7, which states:
That the Permittee herein agrees that there will not be any further outside storage of
commercial vehicles, commercial equipment, private use vehicles, and private use
equipment on the Subject Property, with the exception of parking vehicles and equipment
on the paved driveway to the principal structure in accordance with City Code.

Mr. St. Hilaire indicated he will admit there have been numerous vehicles and boats on the
property, but it is his good stuff. He does repair work during the summer, as he drives a school
bus during the school year. He indicated the way this condition is worded he would have to put
everything he has in the new structure, and he cannot do that. He stated the way it is now he is
allowed to park on the driveway and on Class 5 material, which it is. He indicated if he is going
to he handcuffed by this conditional use permit, he would like to withdraw.

Glenn Simanco, 6311 169th Lane stated Mr. St. Hilaire does have many vehicles across his
property. He indicated it does not really affect his property, since they are not in view of his
home. He stated he received the notice and thought he was going to put everything in this new
structure, but as he started calculating it became apparent he would not be able to do that. He
questions what will be stored in this building.

Bill Herzane, 6231 169th Lane asked what materials will be used in the construction.

Associate Planner Geisler stated it will be hardboard or vinyl to match the color of the house.
She indicated there is some brick on his house and he had wanted those details to match also.
She noted that requirement is part of the permit.

Planning Commission/August 7, 2003
