Cindy Sherman, Director <br />Re: Kenko, Inc. <br />February 24, 1999 <br />Page Two <br /> <br /> In addressing each of the five conditions for the Exception, we satisfy condition one (1) by the fact <br />that our office lease has been terminated and we need to relocate our administrative offices on or before <br />June I, 1999, without such a move to our Ramsey property we will not only incur undue hardship through a <br />detrimental business disruption but also a wasting of corporate assets; condition two (2) is satisfied by the <br />fact that our present use of the property is necessary by June 1, 1999, or its status as a corporate asset will <br />be diminished and certainly not preserved or enjoyed as an existing asset or property right; condition three <br />(3) is satisfied in that granting of the exception will not be injurious to the public weffare or other property <br />as already determined by our expired Development Agreement; condition four (4) is again satisfied by the <br />expired Development Agreement in that our use of the land has been determined to be harmonious with the <br />existing Comprehensive Plan and our willingness to commit to a future connection Mth City sewer & <br />water resolves any concerns that our development would adversely affect any future planning objectives of <br />the City; condition five (5) is satisfied by the fact that our proposed development is consistent with the <br />intent and purpose of this Ordinance in that our development does not conflict with any of the proposed <br />amendments to the Comprehensive Plato ' <br /> <br /> Based upon the foregoing, we respectfully submit this request for an exception from the current <br />building moratorium under Ordinance Number 98-13, thereby, allowing us to complete construction of our <br />office building by June 1, 1999. <br /> <br /> Certainly, ffyou have any questions or need for clarification of items discussed in this letter, <br />please contact me directly. <br /> <br />Sincerely, <br /> <br />Luvem,,McG~-~ ~'dT,~~ <br />Ken_ko, Inc. <br /> <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> I <br />I' <br />i <br />I <br />! <br />! <br />i <br /> <br />I <br />i <br />I <br />I <br /> <br /> <br />
