Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #99-04- RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR THE PURPOSE OF BUILDING FIRE STATION #2 WHEREAS, to provide adequate fire service to the City ofRamsey, a second fire station has been included in the City's Capital Improvement Plan; and WHEREAS, in the 1999 CIP $900,000 was budgeted pertaining to the site acquisition, estimated construction cost, and architectural fees of a new fire station; and WHEREAS, a twenty-year intra-fund loan, funded from the Landfill Improvement Trust Fund, would finance the project; and WHEREAS, the City has authority to acquire the real property for the Public Improvement by direct purchase or eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and WHEREAS, ~ real properties fit the needs of a second fire station. (Addresses will be available at the meeting) NOW THEREFORE BE iT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, COUNTY OF ANOKA, STATE OF MINNESOTA, as follows: 1) That the City Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. 2) That if the real property as described above cannot be acquired by direct negotiation, it shall be acquired by eminent domain. That the City Attorney is authorized to file the necessary petition therefore, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed, or terminated by the City or Court. 4) That the purchase price of said property axed construction of the 2nd fire station will be funded from an intra-fund loan from the Landfill Trust Fund in the amount of $900,000 which was adopted in the 1999 Capital Improvement Program.
