Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-04- <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR THE PURPOSE <br />OF BUILDING FIRE STATION #2 <br /> <br /> WHEREAS, to provide adequate fire service to the City ofRamsey, a second fire station <br />has been included in the City's Capital Improvement Plan; and <br /> <br /> WHEREAS, in the 1999 CIP $900,000 was budgeted pertaining to the site acquisition, <br />estimated construction cost, and architectural fees of a new fire station; and <br /> <br /> WHEREAS, a twenty-year intra-fund loan, funded from the Landfill Improvement Trust <br />Fund, would finance the project; and <br /> <br /> WHEREAS, the City has authority to acquire the real property for the Public <br />Improvement by direct purchase or eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the real property prior to the filing of an <br />award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and §117.042; <br />and <br /> <br /> WHEREAS, ~ real properties fit the needs of a second fire station. (Addresses will be <br />available at the meeting) <br /> <br />NOW THEREFORE BE iT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, COUNTY OF ANOKA, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire the real property as described <br />above in accordance with Minnesota Statutes. The City Administrator is authorized to <br />negotiate and represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That if the real property as described above cannot be acquired by direct negotiation, it <br />shall be acquired by eminent domain. <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed, or <br />terminated by the City or Court. <br /> <br />4) <br /> <br />That the purchase price of said property axed construction of the 2nd fire station will be <br />funded from an intra-fund loan from the Landfill Trust Fund in the amount of $900,000 <br />which was adopted in the 1999 Capital Improvement Program. <br /> <br />That the motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember and upon vote being taken thereon, the following voted in favor: <br /> <br />and the following voted against the same: <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br /> <br />I <br />I <br /> <br /> <br />
