Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-04-.. <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST <br />FROM T.V. RAO FOR A CONDITIONAL USE PERMIT TO ALTER THE <br />LANDSCAPE ON A PARCEL LOCATED IN THE RUM RIVER SCENIC OVERLAY <br />DISTRICT <br /> <br /> WHEREAS, the City of Ramsey received an application from T.V. Fao for a conditional <br />use permit for landscape alterations on the property generally known as 14359 Waco St. N.W. <br />and legally described as follows: <br /> <br />Lot 40, Block 6, River's Bend, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />~4OW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br /> MMSEY, ANO!C4, COUN2~Y, STATE OF MINNESOTA that the findings of fact re!aling <br /> the request are determined to be as follows: <br /> <br />1. That Chapter 9, Section 9.23.10, Sub& 2 (Zoning and Subdivision of Land; Scenic River; <br /> Landscape Alterations; Grading, Filling, Alterations of the Bed of Public Waters) states that <br /> any grading and filling work done within the Scenic River Overlay District shall require a <br /> permit. <br /> <br />2. That on March 19, 1999, T.V. Rao, hereinafter referred to as "Applicant", properly applied <br /> for a conditional use permit to regrade the riverbank and install rip rap on the Subject <br /> Property, which is located in the Rum River Scenic Overlay District, as a result of being <br /> informed by City Staffthat work had commenced without benefit of the proper permits. <br /> <br />That the Applicant's submittal consists of five (5) sheets which include: Exhibit A (1988- <br />1998 Erosion Evidence), Exhibit B (High Water Photo), Exhibit C (Project Plan), Exhibit D <br />(Landscape Proposal Aerial View), Exhibit E (Landscape Proposal River View). <br /> <br />That the Applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on April 6, 1999, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference.' <br /> <br />5. That the Applicant's proposal consists of an erosion control plan that includes reducing the <br /> slope of the bluffand installing rip mp and plant materials to stabilize the bluff. <br /> <br />6. That the Applicant has stated that there will be no soils exported from or imported to the <br /> Subject Property. <br /> <br /> <br />
